PARWA violated National Electrical Code

See this picture. What do you think? Should electrical wiring be like this? Is it not inviting disaster?

If you are not able to place it then let me tell you. It is the open enclosure near the PARWA office. It is not only a possible fire hazard, it also violates National Electrical Code of India. Such jumbling of electrical wires is not allowed. Loose wires should be put in the power socket. A proper 3-pin plug should be used. I wonder how BSES meter reader has not reported this violation to BSES.

PARWA should immediately get it corrected.

मुझे पार्वा प्रेसिडेंट एवं सेक्रेटरी ने फिर नोटिस भेजा है कि कुछ विवासियों द्वारा विजली चोरी करने के लिए बीएसईएस ने जो जुर्माना किया था उसे के लिए १०० रुपये मैं भी भरूं. मैंने काफी पहले इस विषय पर अपना रुख साफ़ कर दिया था कि जिन्होनें चोरी की है दंड वह भुगतें. मैंने इस नोटिस का जबाब दे दिया है:

महोदय,
मैं पहले भी इस विषय में अपने विचारों से आप को अवगत करा चुका हूँ पर लगता है आप लोगों ने मेरे विचारों को न समझने की कसम उठा रखी है. इस विषय में आगे बढ़ने से पहले मैं चाहूंगा कि आप मुझे निम्नांकित डाक्यूमेंट्स की प्रतिलिपियाँ उपलब्ध कराएं:
क्) पार्वा कार्यकारिणी की उन सभी मीटिंग्स के मिनिट्स जिनमें इस विषय पर विचार हुआ हो और निर्णय लिए गये होँ (उपस्थित सदस्यों के नाम सहित).
ख) पार्वा आमसभा उन सभी मीटिंग्स के मिनिट्स जिनमें इस विषय पर विचार हुआ हो और निर्णय लिए गये होँ (उपस्थित सदस्यों के नाम सहित).
ग) अगर बीएसईएस ने पार्वा को विजली की चोरी से सम्बंधित कोई नोटिस या अन्य पत्र भेजा था तब उस की प्रतिलिपि.
घ) अगर बीएसईएस ने विजली की चोरी में लिप्त पाए गये निवासियों को चोरी से सम्बंधित कोई नोटिस या अन्य पत्र भेजा था तब उस की प्रतिलिपि.

इन डाक्यूमेंट्स को पढ़ने के बाद ही मैं इस विषय में आगे कोई निर्णय ले पाऊंगा. साथ ही मैं निम्नांकित मुद्दों पर भी आप का ध्यान आकर्षित करना चाहूंगा:
क्) प्रगति अपार्टमेन्ट्स में लगता है अभी भी विजली की चोरी हो रही है. कुछ उदाहरण:
१) स्कूल की दीवार के पास, गेट संख्या ३ एवं ४ के पास जो कपडे प्रेस करने वाले बैठते हैं वह देर रात तक प्रेस करते हैं और उसके लिए विजली इस्तेमाल करते हैं. अगर इन लोगों ने बीएसईएस से विजली का कन्नेक्शन नहीं लिया है तब क्या यह विजली की चोरी नहीं है?
२) सेन्ट्रल पार्क के मुख्य द्वार पर एक पंखा लगा है जिसे गर्मियों में निवासी हवा के लिए इस्तेमाल करते हैं. अगर इस पंखे के लिए बीएसईएस से विजली का कन्नेक्शन नहीं लिया गया है तब क्या यह विजली की चोरी नहीं है?
३) द्वार संख्या २ एवं ३ पर जो बल्ब लगे हैं उन के लिए विजली कहाँ से ली जाती है? कहीं यहाँ भी विजली की चोरी तो नहीं हो रही है?
४) सेन्ट्रल पार्क में जो कार्यक्रम आयोजित किये जाते हैं उनके लिए विजली कहाँ से ली जाती है? अक्सर डीजी सेट खड़े किये जाते हैं पर उन्हें चलाया नहीं जाता. कहीं यहाँ भी तो विजली की चोरी नहीं हो रही है?
५) द्वार संख्या १ एवं २ के बीच सड़क पर लगे खम्बों पर बल्बों की जो झालर लगाई जाती हैं उन के लिए विजली कहाँ से ली जाती है? कहीं यहाँ भी तो विजली की चोरी नहीं हो रही है?
६) अभी २६ जनवरी पर आयोजित उत्सव में काफी बनाने की मशीन लगाई गई थी जिस के लिए सीधे बीएसईएस फीडर बाक्स से तार जोड़ कर विजली ली गई थी. क्या यह विजली की चोरी नहीं है?
ख) यह नहीं माना जा सकता कि पार्वा कार्यकारिणी को इस चोरी के बारे में पता नहीं है फिर भी कार्यकारिणी इस चोरी को रोकने के लिए कदम क्यों नहीं उठा रही है?

मैं एक बात फिर से स्पष्ट करना चाहूंगा कि मैंने कभी कोई विजली की चोरी नहीं की. मुझे बीएसईएस से जो भी बिल मिलते हैं मैं उन का समय से पहले भुगतान करता हूँ. मुझे बीएसीएस से कभी विजली चोरी का कोई नोटिस नहीं मिला है. मैं यह नहीं समझ पा रहा हूँ कि दूसरे निवासियों की चोरी का जुर्माना मैं क्यों भरूं. पहले ही पार्वा कार्यकारिणी मेरे सब्सक्रिप्शन से मेरी बिना इजाजत के यह जुर्माना दे चुकी है.

गणतंत्र दिवस पर विजली की चोरी

प्रगति अपार्टमेन्ट्स में हमेशा की तरह गणतंत्र दिवस मनाया गया.

हमेशा की तरह इस बार भी गणतंत्र दिवस को आरडब्लूऐ ने विजली की चोरी की. काफी बनाने की मशीन को चलाने के लिए फीडर बाक्स में कनेक्शन जोड़ दिया गया था.

मैं यह नहीं समझ पाता हूँ कि बीएसीएस अपने फीडर बॉक्स में ताला क्यों नहीं लगाते? प्रगति अपार्टमेन्ट्स के सेन्ट्रल पार्क में अक्सर फंक्शन होते हैं, आरडब्लूऐ का दीवाली मेला, निवासियों के प्राईवेट फंक्शन, शादी, इत्यादि. सब ऐसे फंक्शन में विजली की चोरी होती है.

PARWA EC selling/renting land owned by Govt.

It is now official that PARWA has no authority to charge parking fee from residents. It is unfortunate that instead of stopping this illegal charging of parking fee, PARA EC is devising different means to continue with this illegal fund collection. It is funny that EC members and some GB members think that a GB decision can overrule the law of the land.

See what has been recorded in minutes of GB meeting held on 20.11.11:
Decision recorded at S. No. 2 - "The contribution of amount for the additional slot for the vehicles as maintenance and security charges should be continued for the welfare of the residents."
Decision recorded at S. No. 3 - "Data base for the parking slots for all the vehicles of the residents should be made available in the PARWA office."
Decision recorded at S. No. 4 - "If the vehicle for which paid slot is allotted for parking is sold, it should be surrendered to the association within 15 days for the benefit of the others."

The common land inside the apartments is not owned by PARWA. I wonder under what ownership rights PARWA can sell this land or give it on rent in the form of parking slots to residents? PARWA can not hide behind using terms such as, "maintenance and security charges". It is nothing but illegally charging parking fee. In MCD authorized parking lots also, people pay parking fee for security of their vehicle and maintenance of the parking lot including salary of personnel manning the parking lot. Here PARWA is not providing any of these services and simply charging Rs. 1500 per vehicle inside the apartments. The land outside the apartments has also been encroached by PARWA and PARWA is charging Rs. 600 per vehicle. PARWA does not do any maintenance of parking slots. It has not employed any additional security staff. How can it say that amount paid by car owners is for maintenance and security services?

Sometimes I feel that all this is the conspiracy by those residents who do not own a car or own only one car. They pay only monthly subscription but enjoy all benefits for which those residents are forced to pay who own two, three or four cars. To give benefit to these residents, PARWA as a body is indulging in illegal collection of funds and committing violation of the law.

I have been trying for long to reason with EC members but they refuse to see the logic of my arguments. Instead they have painted me as a negative person in the eyes of the residents. They have also issued a circular to defame me.

Now the time has come to make formal complaint to MCD and other concerned authorities. PARWA EC will only be responsible for any consequences.

Payment of minimum wages to PARWA employees

PARWA presently has employed following persons:

One Supervisor, eight Security Guards, two gardners, two sweepers - Total 12 employees.

These employees are not paid minimum wages and are not given other facilities required by law. Their employment in PARWA is totally unregulated. They are not given appointment letter detailing their duties and other terms & conditions of their employment.

No ESI and PF facilities are provided to these employees.

PARWA is a welfare society.It is expected of it to look after the welfare of its employees.

Fire safety in PARWA Office and Manoranjan Kaksh

Every time I enter in PARWA Office and Manoranjan Kaksh, lack of fire safety measures strike me. Seating arrangement in PARWA Office is such that in case of fire it will be very difficult for people sitting there to get out in time. At a time, especially during EC meetings, more than 10 people sit there. The office has only one door and that too of small width. In case of emergency it will be very difficult for people to exit from this door.

Same is the situation in Mnaoranjan Kaksh. During kirtan large number of ladies sit there.

PARWA EC should discuss this issue and install proper fire safety measures. It may also consider changing seating arrangement. Advice of fire expert can be taken.

It should also conduct fire drill to see if people sitting inside are able to come out of office in time. Some security guards should also be trained in fire fighting and first aid.

PARWA EC Members misbehaving with residents

In GB meeting held on 20.11.11, a suggestion was given that residents should cooperate with each other and EC members to avoid conflict. A welcome suggestion indeed, but an incomplete suggestion. It should also have included that EC members should cooperate with residents to avoid conflicts. It is sad that no decision was taken on this suggestion.

Behaviour of some EC members is not good. I had a taste of it when I noticed electricity theft during Diwali Mela. I brouught it to the notice of President and secretary and requested them to stop it and instead use DG set parked outside Central Park. After some time President and a member Mr Vats came to me and started shouting. They also threatened me with dire consequences. They left saying that they will do what they like and no body can stop them. It was good that right sense prevailed and illegal connection to feeder box was disconnected and power was taken during mela from DG set.

Second time it was Mr Vats who not only misbehaved but abused and threatened me of violance in front of many members sitting in Manoranjan Kaksh (for collection of donation for Bhagwati Chowki). Mr Vats had earlier circulated a letter addressed to residents defaming me (Click to read). I had objected to it and had served a notice on Mr Vats to withdraw the letter and tender a public aploogy. A copy of this notice was also served on other members of EC as they were a party to the circulation of letter defaming me.

I am yet to receive reply to my notice. I now intend to serve a legal notice on these people through a lawyer. It is necessary that EC members should stop misbehaving and defaming those residents who are not in their group.

Sir,
I am a senior citizen and resident of Pragati ApartmentsFlat No. 315. I am also a member of Pragati Apartments Residents WelfareAssociation (PARWA – Regn. No. 28337). I have paid my PARWA subscription up toJune 2012 for which a receipt has been issued by PARWA (No. E2770 dated19.07.2011).
01. On 10.09.2011, acircular addressed to all the residents of Pragati Apartments, was issued byShri Jai Vats, PARWA EC member, with mala fide and ulterior motives, inwhich altogether false, baseless and highly defamatory allegations have beenmade against me.

02. It isalleged in the circular – “श्री सुरेश चंद्र गुप्ता जी फ्लेट न. 315 ने दिल्ली नगर निगम को अप्रत्यक्ष रूप से शिकायत की है किपार्वा अनुचित तरीके से (विज्ञापन बोर्डों द्वारा भी) से पैसा इकठ्ठा कर रही है औरधमकी दी है कि वह पुलिस में इस की शिकायत करेंगे. पार्वा कार्यकारिणी के सदस्योंको बार-बार धमकियाँ दी जा रही हैं क्योंकि श्री गुप्ता जी ने इस फंड में कोई भीसहायता नहीं की है और ना ही बिजली “स्टेयर केस फंड” में पैसे जमा करवाए हैं. जब इन से फंड में पैसे जमा करवाने की प्रार्थना कीजाती है और उन्हें डिफाल्टर घोषित किया गया है. इसलिए यह अधिकारियों को धमकियांदेते हैं.”

03. The allegations made by Shri Vats in the circularbesides being false and baseless, are most reprehensible to achieve illegal andnefarious intentions to tarnish my good name, reputation and goodwill for norhyme or reason. Shri Vats have used thename of “PARWA”, and other terms, such as, “पार्वा अधिकारी”, “पार्वा कार्यकारिणी के सदस्यों”, in this circular containingsuch defamatory statements against me, giving an impression to residents thatthis circular has been issued with full knowledge and approval of PARWA EC, andhas been issued as per decision taken by PARWA EC in one of its meeting.

04. Shri Vats and other office bearers and members ofPARWA EC have thus, by words intended tobe read, made or published imputations concerning me in the above saidcircular, intending to harm, or knowingly or having reason to believe that suchimputations will harm my good name and reputation. The said imputations,directly or indirectly, in the estimation of residents, lowers my good name andreputation.

05. Shri Vats andother office bearers and members of PARWA EC have thus committed the offence ofdefamation as defined in Section 499 of the Indian Penal Code, punishable withimprisonment for a term which may extend to two years, or with fine, or both. Ihereby call upon Shri Vats and other office bearers and members of PARWA EC towithdraw above said circular and tender an unconditional apology in the form ofa similar circular addressed to all the residents of Pragati Apartments,within a fortnight of the receipt of this notice, failing which I will have nooption but to take appropriate legal action including claim for damages to becomputed. In such eventuality, Shri Vatsand other office bearers and members of PARWA EC shall solely be liable for thecost, risk and consequences thereof.

06. Shri Vats and other office bearers and members of PARWAEC are informed accordingly.

Who supervised repair of main gate?

Main gate of Pragati Apartments had been damaged by a concrete mixer. It has now been repaired. I wonder who supervised the repair. Advertisement board is tilted to one side and is not vertical. It hurts finer human sensibilities.

DO's & DON'T's - New Telephone Directory

In new telephone directory, Do's and Dont's for PARWA members have been printed. On 27.10.2011, I posted Do's and Don'ts for EC members on Society Website, but the same were not printed in this directory. Read them:

"Code of Ethics for EC members
I propose a Code of Ethics for PARWA EC members:

DO's

a) Every EC member shall work for the welfare of the residents of Pragati Apartments.
b) Every EC member shall work with honesty, integrity, sincerity, team spirit and complete devotion to fulfil the aspirations of residents of Pragati Apartments.
c) Every EC member shll ensure that residents money is spent with care and not wasted in unproductive expenditure, such as conveyence and refreshments.
d) Every EC member shall ensure transparency in day-to-day working.
e) Every EC member shall ensure that inquiries/suggestions/complaints received from members are promptly replied and acted upon.
f) Every EC member shall ensure that every single decision is appropriately recorded and information disseminated to members.
g) Every EC member shall ensure that roles and responsibilities of each EC member are displayed in office and disseminated to members.
h) Every EC member shall display in the office the timings when he will be available in the office so that members can visit the office and meet him for any work.

DONT's

a) No EC member shall indulge in any illegal, immoral and unethical activity.
b) No EC member shall take any action which is in violation of PARWA Bye-laws.
c) No EC member shall promote the interests of individual members and groups and their decisions shall not be influenced by personal vested interests of any individual or group.
d) No EC member shall use PARWA employees, security guards, malis, sweepers, for their personal work.
e) No EC member shall take illegal favours from the vendors by taking their products and srvices free of charge, such as, plumber, electrician, cable guy, internet service provider, vegetable/fruit sellers etc.
f) No EC member shall take commission in cash or kind while granting permission to advertisers and outside agencies who want to display/sell their product/services in the apartments.
g) No EC member shall take commission in cash or kind for granting contract to service providers for holding PARWA functions in the apartments.
h) No EC member will be party to theft of electricity during PARWA functions, such as, Diwali Mela.
i) No EC member shall use PARWA office for doing any work other than official work and attending EC meetings.

These are some Do's and Dont's which I could think of prsently. Any sugestions are welcome."

Minutes of GBM 20.11.11

I could not attend this GBM as I went to Lucknow to attend a marriage in the family. I came to know what transpired at the meeting through recorded minutes of the meeting. As before Shri Malik has recorded the minutes in a manner which raises many doubts about the accuracy of recording. As per some members who attended the meeting, some decision have not been recorded.

I want to discuss following decision:
"On the basis of complaint lodged by Sh. S. C. Gupta R/O Flat no. 315, the process of election was discussed in detail whereas Sh. Gupta did not attend the GBM. It was informed to the house that the nomination of Sh. Gupta was rejected due to non payments of PARWA dues and GBM has agreed to. It was unanimously decided that the election conducted was in order as per the provisions of Bye-Laws. The present EC, should continue to do improvement works for the welfare of the residents."

My comments:
"the process of election was discussed in detail", but no details are recorded in the minutes.
It is not clear from the minutes whether my complaint was circulated to members present in the meeting. If it was not circulated then how members discussed in detail about the election process in view of my objections raised in the complaint?
How it was unanimously decided that the election conducted was in order as per the provisions of Bye-Laws when no member present was informed about the violation of the Bye-Laws raised in my complaint?
Why it was informed to the house that the my nomination was rejected due to non payments of PARWA dues and GBM has agreed to, when this issue was not raised in my complaint.

It is clear that PARWA EC has again played dirty and GB members present in the meeting were wrongly informed, they were not given full information, irrelevant issues were raised, to secure a favourable decision from GB.

I have asked EC to provide me a list of members who attended this GB meeting. I intend to write to them about this and get their views as to how they took the decision as recorded in the minutes without reading my complaint and without hearing my views? What has happened is simply undemocratic.

RWA and encroachments on roads

Delhi High Court has made MCD and Traffic Police officials accountable to local RWA for removing encroachments from roads. Order says that the President and Secretary of the RWA shall also be called for the meetings, to be held at last once a month, between MCD and Delhi Police officers.

PARWA President and Secretary should immediately bring to the notice of MCD and Delhi Police the encroachments around Pragati Apartments and pursue for their removal.

Surrender of LPG connection by PNG connection holders

दीवाली पर भी कूड़ा साफ़ नहीं होगा क्या?

प्रगति अपार्टमेन्ट्स के मुख्य द्वार के दाईं तरफ बहुत सारा कूड़ा पड़ा हुआ है. इस से अपार्टमेन्ट्स की छवि खराब हो रही है. मैंने कुछ दिन पहले पार्वा की आधिकारिक वेबसाईट पर एक पोस्ट लिखी थी पर उसका भी कोई असर नहीं हुआ. आप साथ की तस्वीरों पर क्लिक कीजिए और देखिये. तस्वीरें खुद बोलती हैं.

कौन हटाएगा यह कूड़ा? कल एक चोकीदार ने मुझे बताया कि यह कूड़ा पार्वा का है. मुझे बहुत आश्चर्य हुआ. मैंने जब यह पूछा कि बाथटब और सिंक का पार्वा क्या कर रही है तब उसने कहा कि यह सब एक पार्वा कर्मचारी का है. किसी का भी हो इस कूड़े को तुरंत हटाया जाना चाहिए. पार्वा के सिक्योरिटी इंचार्ज क्या कर रहे हैं? क्या अपार्टमेन्ट्स के अंदर और आस-पास की सफाई की जिम्मेदारी उनकी नहीं है? अगर उनकी नहीं है तब किस की है?

दीवाली आ रही है. अब तो यह कूड़ा हटा देना चाहिए.

Jail for power theft

Time and again I have posted on this blog expressing my concern about power theft. As per a news item in Times of India of 17.10.2011 (click on the image) a woman has been jailed and fined for stealing power.

Many functions are being organized in Central Park and it is its duty to of PARWA EC to ensure that organizers make proper arrangements for power supply. It should be ensured that power is not tapped from BSES Feeder box installed in Central Park.

See what the court has said:
"No leniency must be shown to those who steal power, as it directly contributes to power shortage."
"Electricity theft is on the increase. It also causes loss to the state exchequer. The theft of electricity forces the honest consumer to bear with power cuts. Electricity is a national asset."
"deterrent sentence should imposed in case of repeated offenders. No sympathy should be shown to such offenders otherwise it will be an encouragement to like-minded persons. Such offenders should bear in mind that they will have to face serious consequences, including conviction and imprisonment."

The court has sentence the offender in this case to six months and slapped a steep fine of Rs. 2.76 lakhs.

Complaint against illegal PARWA EC Election

Subject – Complaint against irregularitiesin Election of Executive Committee of Pragati Apartments Residents WelfareAssociation (PARWA), Registration No. 28337

Sir,

I am a resident of Pragati Apartments and amember of its Residents Welfare Association (PARWA), registration number 28337.Recently RWA conducted elections of its Executive Committee (EC). There havebeen many irregularities in this election and many provisions of RWA bye-laws wereviolated. Election Officer (EO) has conspired with outgoing President andGeneral Secretary to ensure their unopposed re-election.

I had filed nomination for the post ofPresident. To ensure that outgoing President, Mr R K Chadha is electedunopposed, the Election Officer (EO) illegally rejected my nomination.

I have raised various objections before andafter my nomination was rejected, but the EO in connivance with outgoingPresident, Mr R K Chadha and General Secretary, Mr A N Malik, had ignored myobjections and went ahead with announcement of election results therebyinstalling an illegal executive Committee.

Some of the irregularities are:

a) Elections have been conductedunder Modified Bye-Laws, whereas the modifications to bye-laws have not yetbeen approved by the competent authority under Societies Registration Act,1960.

b) Outgoing EC appointed Dr V PAggarwal as Chief Election Officer, who issued a circular on 10.04.2011 (copyenclosed) informing the election programme. The EO himself did notfollow/ensure compliance to many provisions of this circular.

c) RWA bye-laws provides for asingle member body (one Election Officer) to conduct election, and for thispurpose outgoing EC or General Body (GB) appoints an Election Officer, but ECin connivance with EO, converted it intoa multi-member body consisting of a Chief Election Officer and two ElectionOfficers. I registered my objection withEO orally. When he ignored my objection, I sent him a letter dated on26.04.2011 (copy enclosed).

d) In my letter to EO dated26.04.2011, I also objected to his having meeting, in the time slot reservedfor filing nominations, with two contestants, Mr R K Chadha and Mr A N Malik,outgoing President and General Secretary, along with some of their supporters. Atleast one member had to file his nomination in their presence.

Both Mr Chadhaand MR Malik kept commenting about nominations being filed. Another resident

went to file his nomination but when he saw these people sitting there hereturned without filing the

nomination. EO had kept nominations confidentialfrom other contestants but made all this

information available to Mr Chadha andMr Malik. By doing so, EO has violated the principle of

natural justice andcompromised his credibility and fairness of election process.

e) After the date of filingnominations was over, list of residents who have filed their nominations wasnot displayed by EO. This information was also available to Mr Chadha and MrMalik but not to other contestants. Mr Malik was seen forcing one contestantfor the post of General Secretary to withdraw his nomination. This candidatefinally withdrew his nomination and Mr Malik was elected unopposed. By makingthe information available to Mr Chadha and Mr Malik, EO has violated theprinciple of natural justice and compromised his credibility and fairness ofelection process.

f) In his circular dated10.04.2011, Election Officer has stated that the list of eligible residents whocan vote and contest shall be displayed by the Executive Committee of PARWA atits office by 20.04.2011 (Para A-3 of the circular). This was again repeated byhim by marking a copy of the circular to President, General Secretary and allEC members requesting them to display the list by 20.04.2011. This list wasnever displayed. When I brought it to the notice of EO, he said that it was nothis job and he can not force EC to display the list. Non-display of this listvitiated the election process as it remained no more just, fair and impartialelection. Two contestants, Mr Chadha and Mr Malik had this information but other contestantswere denied this information willfully under a conspiracy hatched by these two contestantswith EO for rejecting nomination2s of some contestants and thereby ensuringtheir election unopposed.

g) EO had told me and some otherresidents that he had not read the Bye-laws. As he was totally ignorant aboutthe bye-laws, he took advice from Mr Chadha and Mr Malik on issues to bedecided by him as EO. He had taken all the decisions without applying his mind.This makes all his decisions illegal. He has failed to conduct the election ina just, fair and impartial manner.

h) EO had only displayed the listof candidates whose nominations have been accepted by him in late evening of24.04.2011. He did not mention the names of those candidates whose nominationswere not accepted by him and the reasons thereof. The residents till date donot know who filed their nominations, whose nominations were rejected and whatwere the reasons of rejection. Even those who filed nominations do not know whytheir nominations were rejected.

i) On my representation EO gave referenceto some provision of bye-laws which was totally irrelevant for rejecting mynomination for the post of President. He had wrongly rejected my nomination. Hedid not elaborate as to how that bye-law was applicable in my case. Also as hehad confessed that he was not aware of bye-laws how could he take a decision toreject my nomination in view of some irrelevant provision of bye-laws? It isnatural that he has rejected my nomination under the advice of Mr Chadha whowas an interested person.

j) Outgoing President and GeneralSecretary were again the contestants for these posts. There was a

clearconflict of interest. They had important information with them which othercontestant did not

have. They were interacting with EO and advising him. EO wasworking under their advice . EO

also kept everything confidential from othercontestants. All this has made this election a farce.

k) It is also not known whether EOor PARWA EC had informed the competent authority under the Act about thiselection.

l) No member was elected asrepresentative of three blocks. The new illegal EC had nominated threeresidents of their liking as Block Representatives (BR) for these blocks. As tomy knowledge, there is no provision of nominating BR in bye-laws.

m) After displaying the list ofnominations accepted by him, EO had gone out of station. Residents who hadfiled their nominations but did not find their names in this list could not askor discuss it with EO as he was not available. EO should have been present instation for conducting election, and if had some programme for going out thenhe should not have accepted the job of EO. Also he did not inform any residentexcept Mr Chadha and Mr Malik that he will not be available during certainperiod. Mr Chadha and Mr Malik had by proxy become EO.

n) In absence of EO, I hadsubmitted a representation to outgoing EC for re-consideration of appointing DrV P Aggarwal as EO, as he had failed to ensure a just, fair and free election(Copy enclosed). I had requested that an emergency meeting of EC should becalled to discuss this issue. I also requested that I should be invited to thismeeting so that I can present my case in person. But Mr Chadha and Mr Malikignored my representation as the EO had already ensured that they will beelected unopposed. All this has made this election a farce.

I request thatin view of the above and many other issues, the competent authority shouldorder an investigation into the above irregularities in recently concludedelection of PARWA EC. If the competent authority feels that irregularities havebeen done then this election of PARWA EC should be declared null & void.After that, the the competent authority may order fresh election under thesupervision of an officer from his office. It is necessary to ensure that PARWA ECelections are done in just, fair and impartial manner.

PARWA Income thru legitimate Means!

Section 10of PARWA Bye-laws deals with sources of income and utilization of funds. As perthis bye-law:

a) Fundsmay be raised by PARWA by contribution and donation by the apartmentowners/residents/other sources.

b) Fromcommon profits which shall form the nucleus of reserve funds.

c) Sourceof income shall be the admission fee, subscription, penalties realized anddonations.

Collectionof parking fee is illegal both in view of above provisions and laws laid downby MCD as informed under RTI Act. I have brought MCD reply to the notice ofPARWA EC and also in the emergent-extended meeting of EC on 17.09.2011. I haveinformed that when collection of parking fee is associated with threats thatparking slot will be allotted to only those members who pay this fee, PARWAwrongly assumes ownership of the slot and this collection becomes extortionwhich is punishable under law. It was unfortunate that members present in ECmeeting were justifying violations of laws and forcing me to join them in theseviolations. I refused to join them. I strong oppose any violation of any lawand am not a part of any decision taken by PARWA GB/EC which results indirect/indirect violation of any law.

I onceagain reiterate my demands:

a) PAWA EC should immediately stop illegal collection ofparking fee.

b) PARWA EC should give an unqualified written apology forcalling me a defaulter for not paying the illegal parking fee demanded by PARWAEC.

c) PARWA EC should immediately delete my name from the listof defaulters.

d) Election of present EC shouldbe immediately cancelled as my nomination was illegally rejected as I did notpay the illegal parking fee.

d) PARWA should hold fresh election of PARWA EC.

Similarly collection of fee for advertisements and bookingof parks are also illegal as informed by MCD under RTI Act.

I am a senior citizen and have a great respect for law ofthe land. As a responsible member of PARWA, I still feel that PARWA EC andmembers present in EC meeting on 17.09.2011 will see the reason and come out ofa wrong mindset that there is no harm in violating law of the land as long asit generates income for PARWA. I once again reiterate that if PARWA has to raise funds for itswelfare/development schemes then such funds should be raised by legitimatemeans and not by violating laws. I have thought about it and give followingsuggestions for raising funds for PARWA without violating any law of the land:

a) PARWAmay adopt multi-tier subscription system. Amount of parking fee can be mergedin annual subscription for those members who have 2/3/4 or more cars.

b) PARWAmay apply for a license from MCD for display of advertisements ofproduct/service suppliers at the gates and boundary walls of the apartments. Underthis arrangement, advertisement fee will be shared between PARWA and MCD.

c) PARWAmay sign a MOU with MCD for booking of parks for holding functions by PARWA andresidents. Under this arrangement, PARWA will get some amount as service fee orcommission from MCD.

Above systemwill be in conformity of the law and PARWA will continue generating excessincome for its welfare/development schemes.

Mysuggestions can be discussed in an emergent EC meeting. PARWA EC can thenapproach PARWA GB with its recommendations for a final decision.

Let us allmake use of this opportunity to create a synergic effect to raise PARWA togreater heights. Let us not be guided by personal ego and vested personal andgroup interests.

I do not see any activism in PARWA EC on Power-Water Woes

Click on the image to read what is happening in Delhi on power and water front. RWAs all across Delhi are agitated about it but I do not see any agitation in the minds of officer bearers of PARWA on these issues. I have written few posts on these issues on this blog.

PARWA did not submit objections and also did not participate in DERC hearings on unjustified huge raise in power tariff. Yesterday's protest at Jantar Mantar was also not attended by PARWA representatives. Similar is the case of meeting of RWAs with Delhi CM.

What wrong residents of Pragati Apartments have done to deserve such EC officer bearers?

Why discriminate between residents?

I have written a letter to PARWA EC, which is self-explanatory:
"I havereceived your above referred letter and confirm that I will attend the emergentmeeting of PARWA EC scheduled for 17.09.2011 at 07.30 PM.

Yesterday Isaw a circular issued by you relating to the above meeting in which somemembers of PARWA have been invited to attend the meeting. In this connection, Iwill like to put following comments on record and for necessary action at yourend:

a) Myletter dated 06.09.2011 was a notice served on President, Gen Secretary and alloffice bearers of PARWA EC, and as such should be discussed by EC which hastaken wrong actions as detailed in my notice and other earlier letters.

b) Ifyou have decided that these issues should be discussed in a body comprising ofEC members and other members of PARWA then there should be no discrimination inselecting only few members to be invited to this meeting. All PARWA members should be invited. In otherwords, an emergent GB meeting should be called.

c) Effectiveness,efficiency, neutrality and transparency of PARWA EC have been badly affected by‘Group Culture’, where members of these groups work for their supremacy and notfor general welfare of PARWA. Above selection of few members out of larger PARWAmembership will only strengthen this group culture and harm the interests ofPARWA members

With onlyfew members being always in PARWA EC has created arrogance in them. Their mindset has lost the capability to tolerate view points on various issues which arein conflict with their own viewpoints. They do not hesitate in violating lawsto score a victory over those members whom they think are challenging theirauthority. This does not augur well for PARWA, a welfare society bound by itsBye-laws and law of the land.

My basicpurpose of raising various issues is to ensure that PARWA is not caughtviolating the laws of the land and provisions of PARWA Bye-laws. Whenever Iraised these issues, I did not get any positive response from your side. I wasconfronted with an arrogant attitude and a desire to belittle me and my views.A misinformation campaign was launched by you to project me as a person who isanti-welfare. Even my nomination for President PARWA was got illegally rejectedunder a conspiracy between you and the Election Officer.

As part of themisinformation campaign, Shriman Jai Vats, a member of PARWA EC, has circulateda letter misinforming PARWA members. I was shocked to see this letter as in anycivil society no individual addresses such a letter to members of the societyby naming another individual and casting aspersions on him. If he had agrievance with me he should have addressed a private communication to me. PARWAEC certainly should not have behaved in this un-civil manner.

I am a memberof PARWA and my endeavour would always be to ensure that PARWA, as a welfaresociety of residents of Pragati Apartments, religiously follows laws of theland and PARWA Bye-laws. If PARWA has to raise funds for itswelfare/development schemes then such funds should be raised by legitimatemeans and not by violating laws. I am sure that a larger section of PARWAmembership is opposed to any illegitimate means being adopted by PARWA EC andwill not like PARWA to be known as asociety which violates laws.

Pleaseinclude this letter, notice and other earlier letters as agenda referencematerial for the meeting and circulate them to all PARWA members to enable themto ponder on them and come to the meeting with a considered opinion to find outpositive solutions to these issues. Let us all make use of this opportunity tocreate a synergic effect to raise PARWA to greater heights. Let us not beguided by personal ego and vested personal and group interests.

Theproceedings of the meeting should be video/audio recorded. Views of each membershould be appropriately recorded against his/her name. Decision on each issueshould be put to vote and majority point of view should be recorded as thedecision of the meeting. The minutes of the meeting should be circulated to allmembers.

Pleaseinform me of your decision of discussing these issues in an emergent EC meetingas scheduled for 17.09.2011 with no discrimination in selecting invitees or inan emergent GB meeting with all PARWA members."

सभ्य समाज में ऐसा नहीं होना चाहिए

मैंने जब यह पत्र पढ़ा तब मुझे बहुत दुःख हुआ. इस पत्र में श्रीमान वत्स ने पार्वा से सम्बंधित कुछ विषयों पर अपार्टमेन्ट निवासियों को गलत सूचना दी. उन्होंने पत्र में मुझ पर गलत आरोप भी लगाए. सभ्य समाज में किसी को ऐसा नहीं करना चाहिए. अगर श्रीमान वत्स को मुझ से कोई शिकायत थी तब वह मुझ से बात करते या मुझे पत्र लिखते. सार्वजनिक तौर पर एक अपार्टमेन्ट निवासी द्वारा सारे अपार्टमेन्ट निवासियों को ऐसा पत्र लिखा जाना जिस में एक दूसरे अपार्टमेन्ट निवासी पर दोषरोपण किया गया हो, किसी तरह से उचित नहीं ठहराया जा सकता.

क्योंकि इस पत्र में मुझ पर दोषारोपण किया गया था इसलिए मुझे भी एक पत्र जारी करना पड़ा:
"श्रीमान जय वत्स (फ्लेट न. ५७) ने एकपरचा जारी किया है जिस में उन्होंने पार्वा से सम्बंधित कुछ मुद्दों को गलत रूप सेपेश किया है. मैं नहीं जानता कि ऐसा उन्होंने किस उद्देश्य से किया है और यह एकनिवासी के रूप में किया है या पार्वा कार्यकारिणी (पाका) के सदस्य के रूप में. क्योंकिउन्होंने इस पर्चे में मेरा नाम लिखा है इसलिए मेरे लिए यह जरूरी हो गया है कि मैंइन मुद्दों को सही रूप में पेश करूं.
मैंने दिल्ली नगर निगम को प्रत्यक्ष याअप्रत्यक्ष कोई शिकायत नहीं की है. मैंने सूचना अधिकार अधिनियन के अंतर्गत निगम सेयह जानकारी मांगी थी कि क्या निगम ने ऐसी कोई योजना चला रखी है जिस के अंदर निगम ‘रेजिडेंट्स वेल्फेयर असोसिएशंस’ को पार्किंग फीचार्ज करने का अधिकार देता है? निगम ने इस का उत्तर ‘न” में दिया है. इसका अर्थ यह हुआ कि पाका गैरकानूनी रूप से जबरन पार्किंग फी बसूल कर रही है. क्यायह कहने की जरुरत है कि यह एक अपराध है?

मैंने पाका को कोई धमकी नहीं दी है. धमकीदेने का काम पाका करती है. कुछ दिन पहले पाका ने कारों की हवा निकालने की धमकी दीथी. मैंने पाका को एक नोटिस दिया है जिसमें मैंने लिखा है कि यह गैरकानूनी जबरनबसूली बंद की जाय और जिन निवासियों ने यह पैसा दे दिया है उन्हें इसे ब्याज सहितवापस किया जाय. इस बसूली का पैसा न देने वाले जिन निवासियों को डिफाल्टर घोषितकिया गया है उनसे लिखित माफ़ी मांगी जाय. एक षड्यंत्र के अंतर्गत इस आधार पर कुछनिवासियों के चुनाव में नामांकन (मेरा नामांकन भी) गलत तरीके से रद्द किये गए थेजिस के कारण चुनाव गैरकानूनी हुआ. इस चुनाव को रद्द किया जाय और नए चुनाव करायेजाएँ. यह सब न करने की स्थिति में मेरे पास पुलिस और नगर निगम में शिकायत करने काकोई विकल्प नहीं रह जाता.

यह बहुत दुःख और शर्म की बात है कि पाका अधिकारीदेश के कानून और पार्वा बाई-लाज का उल्लंघन कर रहे हैं. उन के इस गैरकानूनीव्यवहार से प्रगति अपार्टमेंट्स के अच्छे नाम पर धब्बा लग रहा है. इसे रोकना बहुतजरूरी है."

श्रीमान वत्स एक शिक्षित समझदार व्यक्ति हैं. आशा करता हूँ कि भविष्य में वह इस बात को नहीं दोहराएंगे.

Notice to PARWA President, Gen Secretary and Office Bearers

I have served following notice to PARWA President, Gen Secretary and other Office Bearers:

"President,Gen Secretary and all other Office Bearers

PragatiApartments Residents Welfare Association

New Delhi – 110063

Throughthis letter I am serving this notice on you for criminal abuse of authority inextorting money from residents of Pragati Apartments for parking/maintenance ofsecond and subsequent cars. PARWA EC/GB have no authority to charge parking orany other fee for parking of cars inside and outside Pragati Apartments. Thisis the exclusive authority of MCD. Acts of President, General Secretary andother Office Bearers of PARWA in this connection are nothing but acts of coercion.

I have beeninformed by MCD under RTI Act that MCD is not operating any scheme underwhich Residents Welfare Associations (RWAs) are authorized to chargeparking/maintenance fee from residents for parking their cars inside the colonyand also outside the colony (see reverse). You have misrepresented facts beforeresidents and cheated them of large amounts of money as parking/maintenancefee.

Under the above misrepresentation of facts and withfelonious intent you have included my name and name of some other residents inthe list of defaulters for non-payment of above fee. You have then conspiredwith the Election Officer for rejecting my nomination for the post of PresidentPARWA by giving him this list but with felonious intent did not display thelist for information of all residents.

I demand from you:

a) an unqualified written apology for calling me a defaulter.

b) deletion of my name and names of other residents from thelist of defaulters.

c) cancellation of the result of election of present EC.

d) holding of fresh election.

e) stop illegal collection of parking fee.

f) return of parking fee with interest to those residentswho have paid it.

If you do not take above actions by 15^thSeptember and confirm the same in the form of a resolution of EC, I will filecriminal complaints against President, Gen Secretary and other Office Bearersof PARWA by their name to police and MCD, and you will be solely responsiblefor any action by the law authorities."

Should PARWA Office Bearers not be prosecuted for breaking the law?

I have written number of posts on this blog. I have also spoken to PARWA Office Bearers. I have also written number of letters to them, but they continued breaking the law. They even rejected my nomination for the post of President PARWA by breaking the law. PARWA has no authority to charge parking/maintenance fee from residents for parking their cars, charging fee from advertisers and also for charging rent for parks for holding functions. In fact MCD has no such scheme where RWAs can be authorized to charge these fees.

This PARWA EC is the result of an illegal election where Election Officer conspired with outgoing President and Gen Secretary to ensure their re-election. Nomination of Block Representatives is illegal as they are required to be elected not nominated as per PARWA Bye-laws. Similarly nomination of Joint Secretary and filling the vacancy of treasurer are illegal.

President PARWA is so arrogant that he is not ready to listen to the reason. His arrogance has forced me to approach MCD through RTI Act to know the law and whether PARWA is acting within the law or breaking it. I have received the reply from MCD and it is clear that PARWA Office Bearers are guilty of breaking the law. See for yourself. Click on the images.

उल्टा चोर कोतवाल को डाटे !!!

आज गैरकानूनी पार्वा कार्यकारिणी ने एक सर्कुलर इशु किया है जिसके पैरा तीन में इन महान पार्वा आफिस बियरर्स ने जो कहा है आप भी देखिये:

"Recently, it has been seen that some of the residents are not cooperating and maintaining harmonious relations and respectable livings with other residents, leading to unspecific problems in the complex. They are also misbehaving with PARWA-Office-Bearers, who are devoting their lot of time in social service and every effort is being made to sort out the problems of the residents."

इसी स्थिति को यह कहावत दर्शाती है - उल्टा चोर कोतवाल को डाटे. इन आफिस बियरर्स ने गैरकानूनी हथकंडे अपना कर पार्वा कार्यकारिणी पर अधिकार जमा लिया है. पार्वा उपनियमों का बेशर्मी से उल्लंघन कर रहे हैं. निवासियों के पैसे का दुरूपयोग कर रहे हैं. कोई निवासी यदि कोई शिकायत करता है तब उसे उचित उत्तर नहीं देते. कोई पत्र लिखता है तब उसका जबाब नहीं देते. ऐसा व्यवहार करते हैं जैसे यह पार्वा के मालिक हैं. पार्वा कर्मचारियों का व्यक्तिगत कार्यों के लिए इस्तेमाल करते हैं. यह भी सुना गया है कि जो वेंडर अपार्टमेंट्स में आते हैं उनसे मुफ्त सामान और सेवा लेते हैं.

यह बहुत जरूरी है कि इस गैरकानूनी पार्वा कार्यकारिणी को हटा कर फिर से चुनाव कराये जाएँ जिस से पार्वा उपनियमों के अनुसार एक कार्यकारिणी को चुना जा सके.

Illegal EC violates yet another Bye-law

Illegal EC also commits contempt of GB

A vacancy has been caused in PARWA EC by the resignation of Shri R C Dhawan, Treasurer. Bye-law 8.8 specifies a procedure for filling up such vacancies. Illegal EC, perhaps not even aware of this Bye-law, filled the vacancy in its own way, which is in violation of the provisions of Bye-law 8.8. Illegal EC has become habitual of taking illegal actions/decisions.

Read the Bye-law:
"8.8 Vacancies - The vacancies in the EC caused by any reason other than the removal of a EC member/office bearer by a vote of the GB of the Association shall be filled by vote of the majority of the remaining EC members, even though they may constitute less than a quorum and each person so elected shall be a office bearer/member untill a successor is elected at the next annual GB meeting."

Illegal EC issued a circular (click on image). This circular says that EC had failed to fill up this vacancy as required by the Bye-law. In that situation EC should have called a meeting of GB where the treasurer could have been elected. But the illegal EC declared that the vacancy will be filled through an election, where EC itself would be the election officer. By taking this action, the illegal EC has bypassed the authority of GB. Illegal EC has created its own illegal Bye-law as there is no provision in approved Bye-law 8.8 of any election to fill up such vacancies. The illegal EC is now in contempt of GB which is the supreme body of PARWA.

Illegal EC's order (click on image) to declare filling up of vacancy of Treasurer in violation of Bye-law 8.8 and in contempt of GB should be immediately withdrawn. An emergent meeting of GB should be called immediately by the illegal President to discuss this matter and other issues related with the vacancy caused by the treasurer including handing over and taking over the charge of the post of treasurer.

Truth behind Bhagidari Certificate

Chadha Malik & CO have been boasting about a certificate received under Bhagidari Scheme. On the basis of this piece of paper they have been claiming that PARWA is the best RWA in West Delhi. Performance of PARWA EC in Bhagidari has been highly disappointing. CLICK to read my earlier post on PARWA performance. Out of 8 projects under "My Delhi I care", PARWA EC could not get even a single project. A sum of Rs 5.5 lakhs was spent by Delhi Govt on these projects but PARWA EC could not a single paisa for welfare of its members.

What Chadha malik & Co could get is a piece of paper which they falsely claim is a certificate that PARWA is the best RWA in West Delhi. As they refused to give any information about their performance in Bhagidari, I filed an application with Delhi Govt under RTI Act. CLICK to read the questions asked in RTI.

I have now received the information. PARWA was given the certificate for:
a) Parks maintained by the RWA through own funds.
b) Constructed boundary wall and fencing by RWA.

So, this is the performance of Chadha Malik & Co for which they are praising themselves. They could not get even a single paisa from the Govt for development of the apartments and welfare of senior citizens. In fact they only spent residents' money on parks and fencing on boundary wall for which Govt has given them a certificate.

TEN RWAs have received cash awards ranging from Rs 25000 to Rs 1 lakh. Out of these one RWA is from B-5 Block, Paschim Vihar, which received Rs 1 lakh cash award. Shamelessly Chadha Malik & Co have claimed that PARWA is the best RWA in West Delhi.

SIXTEEN RWAs have received the certificate. PARWA is one of them. What is so great about it?

Chadha Malik & Co got themselved elected by adopting illegal, immoral and unethical means. They have also ashamedly took credit for this certificate. Their contribution as a good RWA (what to talk of best) is zero. I demand their resignation.

ग्रुप सी फ्लेट्स, प्रगति अपार्टमेंट्स

प्रगति अपार्टमेंट्स में ३५६ फ्लेट्स हैं, जिन्हें ३ ग्रुप्स में बाँट दिया गया है, ग्रुप ए, बी और सी. ग्रुप सी में २३३ से ३५६ तक १३४ फ्लेट्स हैं. इन्हें २ ब्लाक्स में बांटा गया है, २३३ से ३०० (७८ फ्लेट्स) और ३०१ से ३५६ (५६ फ्लेट्स). इन दोनों ब्लाक्स से एक-एक प्रतिनिधि चुना जाता है.

अभी गैरकानूनी ढंग से जो चुनाव हुआ है उस में ग्रुप सी के दोनों ब्लाक्स से कोई प्रतिनिधि नहीं चुना गया. गैरकानूनी पार्वा कार्यकारणी ने पार्वा उपनियमों का उल्लंघन करके श्री टी डी सोनी (फ्लेट संख्या २५५) और कँवर जीत सिंह (फ्लेट संख्या ३०५) को इन ब्लाक्स का प्रतिनिधि मनोनीत कर दिया. पार्वा कार्यकारणी को ऐसा कोई अधिकार नहीं है, पर जिस कार्यकारिणी का चुनाव खुद गैरकानूनी हो, उसे गैरकानूनी काम करने में शर्म कैसी.

श्री सोनी, चुनाव अधिकारी थे. उन्होंने पार्वा उपनियमों का उल्लंघन करके श्री चड्ढा को पार्वा अध्यक्ष पद गिफ्ट किया. श्री चड्ढा ने श्री सोनी को ब्लाक प्रतिनिधि और संयुक्त सचिव का पद रिटर्न गिफ्ट में दे दिया. यह गैरकानूनी है, अनैतिक है, बेईमानी है, इस की किसे चिंता?

श्री कँवर जीत सिंह ने ब्लाक प्रतिनिधि पद के लिए नामांकन भरा था जिसे श्री सोनी ने चड्ढा मलिक एंड कम्पनी के कहने पर रद्द कर दिया. गैरकानूनी चुनाव संपन्न होने के बाद चड्ढा मलिक एंड कम्पनी ने श्री कँवर जीत सिंह को ब्लाक प्रतिनिधिमनोनीत कर दिया. परदे के पीछे ऐसा क्या हुआ होगा जिस से चुनाव से पहले ब्लाक प्रतिनिधि पद के लिए अयोग्य सिंह साहब चुनाव के बाद ब्लाक प्रतिनिधि पद के योग्य हो गए?

ग्रुप सी के गिने-चुने निवासियों को ही यह पता होगा कि यह दोनों महानुभाव उनके प्रतिनिधि हैं, इन्होनें तो ब्लाक निवासियों की कोई मीटिंग बुलाई नहीं, न ही उनसे कोई बात की. पार्वा कार्यकारिणी की कई मीटिंग्स हो चुकी हैं. इन दोनों प्रतिनिधियों ने ग्रुप सी की कोई समस्या इन मीटिंग्स में नहीं उठाई. बस कुछ किया तो चड्ढा मलिक एंड कम्पनी के समर्थन में हाथ ऊंचा किया.

कहते हैं, नंग बड़े परमेश्वर से, जब व्यक्ति शर्म छोड़ देता है तब भगवान् भी उस के सामने असहाय हो जाते हैं.

OK, I will tell you. Name of the block representative is Shri Soni. Surprised? Yes, you should be. Shri Soni was Election Officer in recently concluded election of PARWA EC. After the elections were over , Chadha Malik & Co rwarded him for the favour he gave to them in getting elected unopposed. Yes, yes, it is immoral, unethical and illegal, but who bothers?
Now, the passage as shown in the photos is very frequently used by residents of C-block. Pipe is broken and water flows in the passage. Lot of kachra/malba is lying there for long. A scooter with deflated tyre is parked for long. It is highly inconvenient for residents using the passage.
Shri Soni is not alone who is not bothered about this. PARWA vice-president and treasurer also live in C-block. Day before I saw them chatting just near the malba.
They seem to have selective vision.

Taliban in Pragati Apartments

Today I saw a talibani fatwa issued by illegal President and Gen Sec of PARWA. If you have not seen it then click on the image.

Chadha Malik & Co are becoming bolder by each day. Today they have said that they will deflate the tyres of the cars. Tomorrow they will issue a fatwa that cars will be impounded.

Such decisions should not be taken by EC especially an EC which has been elected illegally, which has block representatives and Joint Secretary illegally nominated in violation of PARWA Bye-Laws. In any case such threats should never be issued to members of RWA. Using a term 'defaulter' for hon'ble residents and members pf PARWA is crossing the limits of civilized behaviour.

An EGBM should have been called to decide such issues. Even GB should shy away from taking such decisions.

Coming back to the issue of deflating car tyres, who will do it, illegal president or illegal Gen Sec or some other illegal member of illegal EC, or security guards will be asked to do this crminal act? Anybody touching a car with ulterior motive will be indulging in a criminal act. He will be accountable to the harm done to car. In the guise of deflating tyres he may steal some components of the car. In any case he will cause huge inconvenience to car owner. A criminal complaint most likely will be filed with the police against the person touching the car. I advise members of the illegal EC not to indulge in any criminal activity which may create a law and order problem in the apartments. If any such problem arises then they will be solely responsible.

This offending circular should be withdrawn and illegal EC should submit an apology for giving threats to residents and hurting their feelings. If it is not done by Monday evening then I will consider filing a police complaint against them for issuing threats to damage the cars and for creating law and order situation in the apartments.

Recreation Centre for Senior Citizens

Department of Social Welfare, Govt of NCT of Delhi, is operating a scheme for financing setting up of recreation centres exclusively for senior citizens. It is a good opportunity for PARWA to explore possiblity of having a recreation centre in Pragati Apartmentsast. I have seen one such centre in Lajpat Nagar, in a park near Amar Colony Market.

Chadha Malik & Co. should immediately get on the job as last date for filing application is 16.08.2011.

Code of Ethics for EC members

I propose a Code of Ehics for PARWA EC members:

DO's

a) Every EC member shall work for the welfare of the residents of Pragati Apartments.
b) Every EC member shall work with honesty, integrity, sincerity, team spirit and complete devotion to fulfil the aspirations of residents of Pragati Apartments.
c) Every EC member shll ensure that residents money is spent with care and not wasted in unproductive expenditure, such as conveyence and refreshments.
d) Every EC member shall ensure transparency in day-to-day working.
e) Every EC member shall ensure that inquiries/suggestions/complaints received from members are promptly replied and acted upon.
f) Every EC member shall ensure that every single decision is appropriately recorded and information disseminated to members.
g) Every EC member shall ensure that roles and responsibilities of each EC member are displayed in office and disseminated to members.
h) Every EC member shall display in the office the timings when he will be available in the office so that members can visit the office and meet him for any work.

DONT's

a) No EC member shall indulge in any illegal, immoral and unethical activity.
b) No EC member shall take any action which is in violation of PARWA Bye-laws.
c) No EC member shall promote the interests of individual members and groups and their decisions shall not be influenced by personal vested interests of any individual or group.
d) No EC member shall use PARWA employees, security guards, malis, sweepers, for their personal work.
e) No EC member shall take illegal favours from the vendors by taking their products and srvices free of charge, such as, plumber, electrician, cable guy, internet service provider, vegetable/fruit sellers etc.
f) No EC member shall take commission in cash or kind while granting permission to advertisers and outside agencies who want to display/sell their product/services in the apartments.
g) No EC member shall take commission in cash or kind for granting contract to service providers for holding PARWA functions in the apartments.
h) No EC member will be party to theft of electricity during PARWA functions, such as, Diwali Mela.
i) No EC member shall use PARWA office for doing any work other than official work and attending EC meetings.

These are some Do's and Dont's which I could think of prsently. Any sugestions are welcome.

Illegal RWA EC Election 2011 - two more illegalities

Some time back I have uploaded a post - Illegal PARWA EC Election 2011 - in which I pointed out many illegalities committed in the election. Two more illegalities have come to my notice. These illegalities relate to Composition of EC, Bye-law 8.2.

a) Post of Joint Secretary - As per the bye-law the post of Joint Secreatry will be filled from the six elected EC members. Today I was surprised to learn that Shri T D Soni of Flat 255 has been nominated as Joint secretary. As per the result declared by EO no body has been elected from the block of flats 233 - 300. How can then Shri Soni can be made Joint Secreatry? He has not been elected as EC member. His nomination as Joint Secretary is illegal and in violation of PARWA Bye-laws.

In addition, Shri Soni was part of the team which conducted the election. He has even been designated (though illegally) as Election Officer by Shri Aggarwal who illegally designated himself as Chief Election Officer. It has been alleged that there was a conspiracy between outgoing President and Gen Secretary and the Election Officer and his team. Is this nomination of Shri Soni is a reward to him given by Chadha Malik & Co for his role ensuring that Chadha and Malik are re-elected? This is immoral and unethical. No body has heard that a member of election commission is nominated to the house after elections are over. This proves the allegation.

b) EC member fron block of flats 301 - 356 - This is second surprise. Shri Kanwar Jit Singh of Flat 305 has been nominated as EC member. As per the result declared by EO no body has been elected from the block of flats 301 - 356. there is no provision in Bye-laws for EC to nominate block representatives. These positions can only be filled through election. Nomination of Shri Kanwar Jit Singh as EC momber is illegal and in violation of Bye-laws.

In addition, Shri Kanwar jit Singh has filed his nomination as block representative. His nomination was rejected by the EO without assigning any reason in writing. But after the election same Shri Kanwar Jit Singh was nominated as EC member. How a person whose nomination was rejected became eligible for the same post after election? This is unheard of. This is illegal and in violation of Bye-laws.

This EC election is really a blot on the fair name of PARWA. If Chadha Malik & Co have any shame left they should immediately resign. An emergency meeting of GB should be called to dissolve this illegally elected EC and fresh elections should be ordered.

Though illegal, PARWA EC should get ready for monsoon

I hope you have seen the public notice issued by MCD about the complaint redressal system to deal with the problems in monsoon season. If not then click on the image.

Has PARWA EC prepared itself for coming monsoon and how to address the problems of water logging, fallen trees, manhole covers, sanitation, repair of potholes or any other problem? I am sure they have not even thought of it. PARWA EC should immediately hold an emergency meeting and discuss this issue.

Block representatives should be specifically asked to keep an eye on monsoon related problems in their respective blocks. A coordinator should be appointed to coordinate with civic agencies. Whenever a complaint is received from a resident or a block representative, he should immediately report to concerned civil agency at the phone number given in the public notice. A complaint number will be given to him by the agency, and he should closely monitor the actions being taken by the civic agency to effectively solve the problem.

Residents should be informed about name and phone number of the coordinator.

Though illegal, PARWA EC should do its duty

Sometime back I wrote a post about massive power tariff hike. CLICK to read it if you have not read it so far.

Has Chadha Malik & Co. filed objections/comments on the proposals of DISCOMS asking for massive hike in power tariff not only for 2011-2012 but also for recovery of dues from consumers for 2008-2009 and 2009-2010 after increasing the tariff for these two previous years? I am sure they have not done so. The massive power hike is going to hit hard. They have failed to do their duty.

Now DERC has given them another chance. The last date for submitting objection/comments has been extended up to 01.07.2011. Now they should immediately file objections/comments and attend the hearings as per programme (see the image) to present views of the residents of Pragati Apartments.

I know that the new EC has been elected illegally but they are occupying the PARWA Office and so have a duty towards the residents of Pragati Apartments.

Unite and fight against massive power tariff hike

I am sure residents of Pragati Apartments are aware that the threat of a massive power tariff hike is looming large. Stakeholders and various consumer activists have been preparing to fight it out in the public hearing scheduled to be held in this month. I am not sure whether PARWA has submitted any objections to DERC.

The massive power hike is going to affect every one of us. The private Discoms are asking for significant hike in tariff for 2011-12 with BSES Yamuna is asking for a 85 % hike, BSES Rajdhani a 67 % hike, and NDPL a 50% hike.

Illegal PARWA EC will not do anything. The residents will have to act independent of PARWA EC. A group should be formed and a plan should be prepared to fight out this unjust hike.

Illegal PARWA Election 2011

I have been discussing with legal experts the illegalities committed by the Election Officer (EO) and outgoing President and General Secreatry, Mr Chadha and Mr Malik in PARWA Election 2011. There are many ileegalities:
a) Elections were held under modified bye-laws which were not approved by the competent authority under the Act.
b) Many provisions of the bye-laws were violated.
c) as per his own admission, EO has not read the bye-laws. How could he conduct the election when he was not aware of the election law?
d) EO conspired with outgoing President and General Secreatry, Mr Chadha and Mr Malik in rejecting nominations of some contestents.
e) As outgoing President and General Secreatry, Mr Chadha and Mr Malik were themselves contesting the election, there was clear conflict of interest. As EO was unaware of bye-laws, Mr Chadha and Mr Malik became the de-facto Election Officer.
f) The list of members, eligible to contest and vote in the election, was not displayed by outgoing President and General Secreatry, Mr Chadha and Mr Malik.
g) List of residents who filed their nomination was not displayed by EO.
h) List of residents whose nomination was rejected by EO was not displayed by EO.
i) Objections filed by a contestent were not appropriately addressed by EO and were rejected without applying his mind and against the principles of natural justice.
f) Objections filed by a contestent were not appropriately addressed by outgoing EC and were rejected without applying i mintsd and against the principles of natural justice.
g) Residents, whose nominations were rejected by EO, were not informed of rejection and reasons thereof, not giving them any chance to contest the grounds of rejection. This is against the principles of natural justice.
h) EO was found by residents having meeting and partying with outgoing President and General Secreatry, Mr Chadha and Mr Malik during time slot fixed for filing nominations. This is against the principles of natural justic and also shows that EO was in conpiracy with them.

There may be many other violations which I am studying. Legal experts have advised some actions which also I am studying and will take as advised.

This illegal election is a blot on the fair name of PARWA and Pragati Apartments. It is the duty of every resident to protest these illegalities and get this illegal election set aside.

Bhagidari - RTI about PARWA EC performance

As illegally forced in PARWA EC, Mr Chadha and Mr Malik have refused to give any information about their performance in Bhagidari, I intend to file an application with Delhi Govt under RTI Act. The quaestion are as follows:

"Smt Sheila Dikshit, Chief Minister of Delhi has awarded a Certificate of Recognition to Pragati Apartments Residents Welfare Association (PARWA), Paschim Vihar for appreciable contribution to Bhagidari initiative in 2010. Relating to this, please provide following information under RTI Act, 2005:

a) Give details of all the awards given to RWAs under Bhagidari initiative.

b) Is cash also given to RWAs along with some awards? Give details of such awards and amount of cash award.

c) Provide a list of RWAs who have been given awards in 2010 along with details of contribution made by these RWAs to Bhagidari initiative including by PARWA.

d) What are the criteria for selection of RWAs for giving awards? Give full details.

e) What is the procedure followed for selecting RWAs for these awards? Give full details.

f) Is there a committee which selects the RWAs for giving awards? Give details of such committee and its members.

g) Do the members of above committee visit the colony of RWAs and what aspects of RWAs functioning are checked/verified?

h) On what dates the committee visited Pragati Apartments and what were its findings. Give all details.

i) Who represented PARWA during the visits of committee members to Pragati Apartments and during other interactions?

j) Can a RWA after getting the Certificate of Recognition claim that it the best RWA in the area?

k) Is it checked and verified that RWA follows the laws of the land, such as, paying minimum wages and overtime at prescribed rates to its employees? Was it checked in case of PARWA?"

Who represents PARWA in RWC?

As new PARWA EC is illegal, its occupation of the office of PARWA is illegal. I am taking appropriate steps to get this election declared null & void. Till such time members of PARWA will have to deal with this illegal EC.

MCD has constituted RWCs to give more and better say to RWAs in the development of their residential complexes and surrounding areas. For this purpose PARWA was to nominate a resident to this area's RWC. This illegal EC has not informed PARWA members about this.

As a member of PARWA I demand to know:
a) Name of the resident who has been nominated to RWC.
b) How the name of this PARWA representative was decided?
c) Has any meeting of RWC has been held so far?
d) What issues were projected in RWC by PARWA representative?
e) Why PARWA members have not been informed about this?

Mr Chadha and Mr Malik, the illegal occupiers of the positions of President and Gen Secretary, have been behaving in an arrogant manner. Working of PARWA EC is not transparent. If they have any self-respect then they should immediately step down and let fresh elections be called by PARWA GB.

Paying subscription fee to PARWA is mandatory

Why I did not speak in last AGBM?

A member has commented in C-box:
"member: SC Gupta never opens his mouth in GB or anywhere, he only writes untrue thing in web and hide."

I would say both Yes and No.

In last few meetings of GB, I have spoken but it was of no use. There was no discipline. There used be no respect for chair. People used to shout at each other, even coming to exchanging blows with each other. These were only group fights, trying to score over other group. No proper discussion, no proper announcement of decisions on issues, no proper recording of decision in the minutes.

I wanted to speak in last AGBM. There was an important issue of illegal EC elections. I had given a representation to Mr Chadha, asking EC to hold its emergency meeting and invite me to present my views in person on the illegality in election process. I had also asked EC to discuss its decision in AGBM. Mr Chadha did not reply to my representation, neither it was discussed by EC, nor was I invited to EC meeting. He also did not put up my representation before GB.

I could have raised this issue in AGBM but was discouraged by many factors. Only 14% of members were present. The strong presence of ladies baffled me. I was given a hint by some residents that I will not be allowed to speak, that I will be shouted down. I never believed that Mr Chadha will go to such extent to defend his illegal actions. I did not want a situation in AGBM which will further erode the good name of PARWA.

I am all for discussion but a sincere and to-the-point discussion. I am ready for any debate at any time with Mr Chadha and/or any other member(s) of this illegal PARWA EC. Let them come forward and have an open debate in Central Park.

Now coming to writing untrue things and hide - I have never written anything untrue. What I have written in available on the blog. Let anybody answer that and prove that it is untrue. And who is hiding? This member has not commented under his real name. This is my blog and everybody knows it. I am not hiding from anybody.

Illegal PARWA EC is against children

Have you seen the minutes of AGBM held on May 1, 2011? The great Mr Malik had recorded the following as a decision taken in this meeting:
"5. Children should not be allowed to play in the park."

First it is a wrong recording. No such decision was taken. The issue was no doubt raised and some discussion took place, but it was inconclusive. A member even said that Delhi High Court has given a decision that children will play in the parks. How PARWA GM can decide against the decision of Delhi High Court.? I am not a legal person but will it not be treated as a Contempt of Court?

I want to ask PARWA one question. Where children will play if they are not allowed to play in the parks? Has PARWA made some alternative arrangement for this? The oldies in PARWA are much beyond the age of playing, but for children playing is very important. How can they be stopped from playng in the parks, and that too after the High Court decision?

Only 14% members attended the AGBM and only a few of them might be against children playing in parks. How can "Children should not be allowed to play in the park" be recorded as a majority decision of PARWA? This is wrong. The minutes should be amended and re-circulated. Mr Malik and Mr Chadha can not wrongly draft the decisions of PARWA.

Moreover this PARWA EC has been declared elected by Election Officer in an illegal manner. Its members have no moral, legal and ethical right to work as EC members . Both Chadha and Malik are vulnerable to a conflict of interest in dealing with election issues as they themselves were contesting the election of President and General Secretary. Misusing their position they did not display the list of those members who were eleigble and not-eleigible for contesting and voting in the election. By hiding this information, they illegally ensured their election to new EC by advising election officer to reject some nominations including that of Mr Gupta for the post of President. Election officer had informed that he did not read the Bye-Laws and was found having a meeting with both Mr Chadha and Mr Malik.

This illegal election is a blot on the fair name of PARWA. To restore PARWA's fair name this election should be cancelled and fresh election should be ordered.

Bhagidari - Projects Under "My Delhi I Care"

I was reading about Bhagidari scheme of Dekhi Govt relating to West Delhi. I found a list of completed projects under "My Delhi I care". CLICK to Read.

You will notice that out of 8 projects 5 belong to Rama Park (C-Block) RWA. These are:

1. Provision of Iron Gate and sinage indicating name of colony/Association at entrance, C-Block Rama Park
2. Provision for recreation centre for Senior Citizen
3. Provision for main hole cover
4. Provision for Iron Gate adn sign ages
5. Provision for construction of entry gate at three locations and sign board

The total cost is about 5.5 lakhs.

What is the performance of PARWA EC in this respect - a certificate printed on a piece of paper?

रविवार, १ मई २०११ को हुई पार्वा आम सभा की बैठक में श्री धवन ने मनोरंजन कक्ष के लिए ११०० रुपये दान में देने की घोषणा की थी. इस बारे में श्री मलिक द्वारा तैयार किये गए मिनिट्स में कोई जिक्र नहीं है. क्यों ???

क्या धवन साहब इस दान को देने से मुकर गए या फिर मलिक साहब ने यह धन आपस में बाँट लिया?

हिन्दू धर्म के अनुसार एक बार व्यक्ति जो संकल्प कर लेता है उस से मुकर नहीं सकता. धवन साहब ने ११०० रुपये देने धवन साहब ने ११०० रुपये देने का संकल्प किया था, अब यह धन उनका नहीं रहा. उन्हें यह धन पार्वा के पास जमा कर देना चाहिए. मनोरंजन कक्ष में जब उस की आवश्यकता पड़े, पार्वा इस धन को खर्च करे.

मलिक साहब को आम सभा की मीटिंग के मिनिट्स में संशोधन इशू करना चाहए.

History repeated itself

Annual GB meeting of PARWA revived the memories of my school days when we were taught in history class about the starategies adopted by Mughal invadors in the war against Indian kings. Armies of both sides would be facing each other in the battlefield. Mughal invadors will form lines of women and children in the front. Hindu kings and their forces would hesitate to attack them and this will affect their fighting ability. Mughal invadors will win with ease.

My Parents have taught me - yatra naryastu pujyante ramante tatr devta, meaning where women are respected, Gods reside. In Hindi, जहाँ नारी का सम्मान होता है वहां देवता निवास करते हैं. I wanted to raise the issue of illegality in election process but the presence of women in the front line forced me to keep quiet. I lost that round of battle against dirty group politcs of outgoing plus incoming President of PARWA. The history repeated itself in Pragati Apartments.

Such low grade politics in the name of serving the residents.

Declare the election null & void

Election to PARWA EC 2011-2012 should be declared null & void.

The election conducted by Dr V P Aggarwal, Election Officer (EO), is a blot on the name of PARWA.

Election Officer worked as AGENT of Mr Chadha, outgoing President, and again a candidate for the post of President in this election.

The election had not been fair and free.

Election Officer violated PARWA Bye-Laws, did not follow his own circular and took decisions in violation of Principles of Natural Justice.

This election has a distinction where the election officer has not even read PARWA Bye-Laws. He has accepted his appointment as Election Officer to conduct election as per the provisions of the Bye-Laws but he has not even thought it necessary to read the Bye-Laws. As he was not aware of the provisions of PARWA Bye-Laws, he could not and did not apply his mind but choose to follow the advice given to him by the outgoing President, Mr Chadha.

As Mr Chadha was himself a contestent for the post of President PARWA, there was a clear conflict of interest. Mr Chadha misused this official position and gave such advice which will ensure his unopposed election as President PARWA. EO worked as Mr Chadha's agent and ensured it. He rejected the nomination of Mr Gupta who had also filed nomination for the post of President PARWA.

EO gave no reasons for rejecting the nomination of Mr Gupta. When Mr Gupta asked EO in writing then EO gave him a reason under which Mr Gupta's nomination can not be rejected. Mr Gupta submitted a representation to PARWA EC, the body which has appointed the EO, asking EC to reconsider the appointment of EO in view of the above and some other points, but Mr Chadha again misused his position and took no action on this representation. He did not call the emergency meeting of EC and also did not discuss this issue in the GB meeting. He ignored the representation as any re-consideration of EO's appointment would have spoiled his chances of again becoming President PARWA.

As PARWA Bye-Laws have no system of Grievance Redressal against the illegal decisions of PARWA President and EO and their dictatorial attitude, there is no option left except approaching the Registrar of Societies for declaring this election null & void, order fresh elections and conduct the election under the supervision of an officer of the office of Registrar of Societies.

A detailed complaint is being drafted. Any inputs for this complaint are welcome.

Broken promises, वादा खिलाफी, वचन भंग करना.

Sant Tulsidas has written - रघुकुल रीति सदा चली आई, प्राण जाएँ पर वचन न जाई.

Some people will say that Sant Tulsidas has written it about Raghukul, the family of Lord Ram. Human beings, like us, can not be expected to follow such hugh standards. To some extent I will also agree with this, but people should at least try to keep their promiss. They should not break promises just like that.

Last year Mr Chadha made two promises. He had filed nomination for the post of President. I had also filed the nomination for this post. Mr Sachdeva and Mr Dhawan came to my house and told me that I should withdraw my nomination as Mr Chadha wanted to be President for one term. To justify their submission they talked very high of Mr Chadha. I did not agree. Then Mr Chadha paid a visit to me. He also said the same thing that he wanted one term as president. I did not agree to withdraw and said that let there be election as it is the correct democratic process. After some discussion he said that he did not want election and if there was election he would withdraw. I said that it was OK with me. He then promised to withdraw. He failed to keep his promise.

After date of withdrawal, there were two contestents, me and Mr Chadha. Now elction was a must. Mr Chadha had however kept insisting that there should be no election. It was beyond my understanding that why he was bent upon breaking the law. One day he told me that he wanted to become President for one term. As there was going to be election, he told me that he was under lot of stress. He even told me that he was suffering from blood pressure and might have a problem. I was shocked. It was emotional blackmail. The pressure was too much. I gave in and told him that I would come with him to all the residents and request them that I had withdrawn in favour of Mr Chadha and they may vote for him. I don't know how but he pursuaded the Election Officer and both of them said they would cancel the voting. I told them that it would be a violation of law, but they went ahead and announced the result that Mr Chadha was elected unopposed. Both of them told me that no body will raise any objection. Mr Chadha promised me that it was for one term only and in next election he would himself propose my nomination. He did not keep this promise also. He not only failed to keep his promise but he went ahead to conspire with this Eloection Officer also and got my nomination rejected.

WHY PEOPLE BREAK PROMISES, AND THAT TOO FOR STICKING TO THE POST OF PRESIDENT OF PARWA?

PARWA GB Meeting May 2011

Today PARWA had its General Body meeting. This was the last meeting of outgoing PARWA EC. The time fixed for the meeting was 10.00 AM. At 10.05 AM, four residents were present. From PARWA EC side - President, General Secretary and a Block Representative. From GB members - me. President adjourned the meeting to again start at 1030 AM. Meeting finally started after 1030 AM with seven members (out of 12) from EC and about 16 members from GB. Nine members of PARWA EC did not reach the meeting place at 10.00 AM, and 5 were altogether absent from the meeting. It is to be noted that this was the time decided by the EC itself. One notable absent EC member, Mr Vats has again filled up his nomination for another one year term. Are there any benchmarks to be met by EC members in respect of punctuality and regularity? This was first point which should have been discussed in the GB meeting.

There are 365 flats in Pragati Apartments. About 50 flats were represented in the GB meeting. What does it mean? Only about 17% members took decisions which will affect remaining 83%. In addition, these are only majority decisions. All present members did not support these decisions. Can we call the decisions taken at GB meeting representing the interest of all the members of PARWA? A big NO.

Now why all the members do not attend these GB meetings? What are the reasons that a big majority remains aloof from the working of PARWA? This was second point which should have been discussed in the GB meeting.

Now whose job is to make PARWA a body where all members attend its meetings? Is it the job of President and other officers bearers/members of PARWA EC? Is PARWA EC a representative body of PARWA GB or is it only a caretaker sort of arrangement to take care of PARWA day-to-day matters? This was third point which should have been discussed in the GB meeting.

There was no decorum in the meeting. There was cross-talk not only amongst GB memebrs but also on the dias. Quality of sound system was very bad. Nothing was heard clearly. You can see this in videos, where visuals are recorded but no audio. There was lot of noise created by fans. In one case you will see a security guard almost snatching the mike from a speaking EC member. In one case, a EC member is seen gesticulating at GB members.

At one point, President commented that people come to GB meeting to only do खिंचाई of EC. Some GB members objected to it. They said that if this was the attitude of EC then what was the use of calling GB meeting and having discussions. Then it was the turn of the Treasurer to call GB members "rats". A GB member objected to it, but other members tried to pass it on as humour. Decorum was the fourth point which should have been discussed in the GB meeting.

President made a very important observation that if he puts PARWA to a loss of Rs One Lakh, then what action can be taken against him. PARWA Bye-LAWS have not provided for any grievance redressal mechanism. GB members have complaints against EC members but there is no forum where they can file their complaints and seek redressal of their grievances. This was fifth point which should have been discussed in the GB meeting.

A point was raised about inconvenience being caused to residents having flats facing Central Park by functions being held in the park. The issue was discussed but no clear decision was taken.

Another point was raised about the quality of security being provided. Some discussion took place but no clear decision was taken.

There are many such issues. I will talk about them later. I want to see how General Secretary records the discussions and decisions. There was no clear announcement by President about the decision taken after discussion on many issues.

Steamrolling the Election Process by Election Officer

In my last post I have uploaded two letters written to election Officer, Dr V P Aggarwal bringing certain issues to his notice and requested his comments on those issues (my letter dated 26.11.2011). As he has rejected my nomination for the post of President, PARWA, I had requested him to inform me the basis on which he has rejected my nomination and the documents on which he has based his decision. The second letter was delivered to him personally at 0745 PM on 27.04.2011. His reply to my letter was delivered to me by a security guard at 0910 AM on 28.04.2011.

You can read his reply by clicking on the image. You will note that he has taken only 45 minutes to reply to my letter. This shows his insincerity and lack of respect for PARWA Bye-Laws and a member of PARWA. He has earlier told me and some other members of PARWA that he has not read the Bye-Laws. Now he simply gives reference to a Bye-Law and says that all my charges are strongly denied and disposed off.

Now let us see what is Bye-Law No. 5? This Bye-Law is about Cessation, Appeal and Re-admission of PRAWA Membership. It no where says anything about rejection of the nomination of S C Gupta for the post of President PARWA. In fact Election to PARWA EC is governed by the provisions in Bye-Law 8.4.

I am surprised at this offensive and illegal attitude of Dr V P Aggarwal, who has been appointed as Election Officer by outgoing PARWA EC to conduct a free, fair and just election. He has taken a wrong decision to reject my nomination. He is duty bound to inform me the exact reason(s) of the rejection. He did not inform me about it before releasing the list of contestents whose nominations have been accepted by him. I could have given suitable explanations to his objections to my nomination. Now also he is not providing me any details of the reasons of rejecting my nomination. This is nothing but a dictatotial attitude and a wilful denial of free, fair and just election process. He seems to be having a hurt ego. He is trying to steamroll the election process and forcing me to accept his unjust illegal decision to reject my nomination. He has become a liability on the free, fair and just election process of PARWA EC. PARWA EC should immediately re-consider its decision appointing him as Election Officer. He has failed to conduct the election in a free, fair and just manner.

Dear Sir,

Through this letter I wish to bring to your notice some disturbing developments in the process of Election of PARWA EC for the term 2011- 2012.

1. As per PARWA Bye-Law 8.4, the EC or GB will appoint an Election Officer from apartment owners. Further, the Election Officer can take help of any of the GB members/s for conducting the election. The circular issued by you on 10.04.11 has been signed as Chief Election Officer. I am of the view that the designation as given in PARWA Bye-Laws should have been used. A different designation may be termed as violation of the relevant Bye-Laws.
2. Copy of the above circular has been marked to the President and General Secretary of PARWA to display duly signed and certified list of eligible members of PARWA by 20th April 2011. This list has not been displayed so far.
3. You have taken help of Shri S P Suri and Shri T D Soni for conducting the election. While this is in accordance with provisions of Bye-Laws, designating them as Election Officer is in violation of Bye-Laws as Bye-Laws do not permit a multi-member body to conduct election. Also these residents do not have any official role in the election process and can not sign any official papers.
4. A resident, who has submitted his nomination paper, has informed me that when he went to your office on 24.04.11 at 0745 PM, he found number of people sitting with you in a meeting and also a party was on. Notable amongst them are Mr Chadha and Mr Malik, outgoing President and General Secretary of PARWA. This is clearly illegal and unethical.
5. The time slot of 0700 – 0800 PM has been reserved by you for receiving nomination papers. Allowing other contestants and their supporters to sit with you during this period and having a meeting with them puts a big question mark on the impartiality of election process. Election Officer is an independent functionary and such interactions with outgoing President and General Secretary will naturally be viewed with suspicion that you are siding with them and disclosing the names of other contestants to them for possible exploitation an vitiating the election process..

I will request you to take necessary action on the above points to ensure that election process remains totally impartial. I also request you to offer your comments on above points.

On 26.04.2011, you have issued a circular after 0800 PM containing the list of names of candidates whose nominations have been accepted by you. I was surprised that the list did not contain my name.

If my nomination has not been accepted by you then it should have been mentioned in the circular along with the reasons for not accepting the nomination. You have also not informed me about this in any separate communication to me. Please inform me without any more delay the reasons for rejecting my nomination along with copies of any documents based on which you have taken the decision to reject my nomination.

My letter dated 26.04.2011 delivered to you in the morning has not been replied by you so far. I had expressed my doubts on the impartiality of election process being conducted by you. As per your circular dated 10.04.2011, list of eligible members to contest and vote was to be displayed by 20.04.2011 but has not been displayed so far. You have not ensured display of the list by outgoing President of PARWA by 20.04.2011. You have failed in your duty to conduct the election in a fair and just manner.

With above rejection of my nomination, I am convinced that you have conspired with outgoing President of PARWA to elect him unopposed by rejecting my nomination.

I will request you to immediately reply my two letters.

Corruption in PARWA EC Election 2011

Normally people think that corruption is giving or accepting money or any other favour for doing or getting such work done which is not permissible under law. This is a misconception. Corruption has many forms. Misuse of official position to favour self or harming others is corruption. Conspire to violate law to achieve a set objective is corruption. Withholding information to put self to advantage and others to disadvantage is corruption. The list is very long. What has transpired in PARWA EC Election 2011 is one or more of these forms of corruption.

Outgoing President misused his position to install himself as President for yet another term. As larger public opinion is against his continuation and wanted a CHANGE in the EC, he misused his position to ensure his re-election by not displaying the list of eligible / ineligible PARWA members for contesting and voting in the election. As per Election Officer's circular he was required to display the list on 20th April 2011. The list had not yet been displayed (27th April 2011). He had the nformation and made it sure that other contestents do not have it. He exploited it to his advantage and conspired with Election Officer in getting the nomination of one PARWA member (S C GUPTA) rejected, to prevent him to contest for the post of President, so that he himself is elected unopposed.

The last date for filing nominations was 24th April 2011. If the list was displayed on 20th April 2011, any member who was not eligible but wanted to contest, could have known about his ineligibility and could have taken necessary action to become eligible. Afterall the purpose of displaying the list is to ensure that all residents participate in the election. The purpose can not be to prevent some residents from contesting the election. But the outgoing President misused his official position to ensure that a willing resident is prevented from contesting for the post of President, so that he himself is elected unopposed.

The outgoing President has indulged in corruption by misusing his official position to get himself elected upopposed. He had vitiated the election process. He had put a big question mark on the impartiality of election process.

In the interest of justice and fairplay, the election process should be immediately suspended, and the issue of corruption relating to misuse of official position by the outgoing President should be discussed in the Genral Body meeting scheduled for 1st May 2011.

धीरे-धीरे और आवंटिती भी अपने फ्लेट्स में शिफ्ट होने लगे. गेट बने, विजली एवं पानी के कनेक्शन मिले, फ्लेट बनने का काम पूरा हुआ, सड़कें बनी, पार्क बने, जिंदगी धीरे-धीरे सामान्य होने लगी. कालोनी का नामकरण हुआ - प्रगति अपार्टमेंट्स. रेसिडेंट्स वेलफेयर असोसिएशन बनी. शर्मा जी ८ वर्ष पार्वा के अध्यक्ष रहे. आज प्रगति अपार्टमेंट्स जिस हॉल में है, उस में शर्मा जी का महत्वपूर्ण योगदान है.

होलिका दहन

होली की पूर्व संध्या में होलिका दहन किया जाता है. इसके पीछे एक प्राचीन कथा है कि दीति के पुत्र हिरण्यकश्यपु भगवान विष्णु से घोर शत्रुता रखता था . इसने अपनी शक्ति के घमंड में आकर स्वयं को ईश्वर कहना शुरू कर दिया और घोषणा कर दी कि राज्य में केवल उसी की पूजा की जाएगी. इसने अपने राज्य में यज्ञ और आहुति बंद करवा दिया और भगवान के भक्तों को सताना शुरू कर दिया. हिरण्यकश्यपु का पुत्र प्रह्लाद भगवान विष्णु का परम भक्त था. पिता के लाख कहने के बावजूद प्रह्लाद विष्णु की भक्ति करता रहा.

असुराधिपति हिरण्यकश्यपु ने अपने पुत्र को मारने की भी कई बार कोशिश की परंतु भगवान स्वयं उसकी रक्षा करते रहे और उसका बाल भी बांका नहीं हुआ. असुर राजा की बहन होलिका को भगवान शंकर से ऐसा चादर मिला था जिसे ओढ़ने पर अग्नि उसे जला नहीं सकती थी. होलिका उस चादर को ओढकर प्रह्लाद को गोद में लेकर चिता पर बैठ गयी. दैवयोग से वह चादर उड़कर प्रह्लाद के Šৠपर आ गया जिससे प्रह्लाद की जान बच गयी और होलिका जल गयी. होलिका दहन के दिन होली जलाकर होलिका नामक दुर्भावना का अंत और भगवान द्वारा भक्त की रक्षा का जश्न मनाया जाता है.

पार्वा कार्यकारिणी गलती दोहरा रही है !

कल मैंने एक पोस्ट लिखी थी - सावधानी हटी और दुर्घटना घटी. कल ही पार्वा कार्यकारिणी ने टूटे पिलर की मरम्मत का काम शुरू कर दिया. लेकिन पार्वा कार्यकारिणी पुरानी गलती दोहरा रही है. पिछली बार टूटे पिलर को फिर से नया नहीं बनाया गया था, जहाँ से टूटा था वहीँ से फिर बना दिया था. नतीजा, इस बार पिलर फिर वहीँ से टूट गया. इस बार भी वही गलती दोहराई जा रही है, यानि कल फिर किसी दुर्घटना को निमंत्रण दिया जा रहा है.

मुझे बताया गया है कि ट्रक वाले से ८००० रूपए हर्जाना लिया गया है. मेरी समझ में नहीं आता कि इन रुपयों से पूरा पिलर दोबारा क्यों नहीं बनबाया जा रहा? जो हर्जाना लिया गया है उस में से रूपए क्यों बचाए जा रहे हैं? पिलर को नया बनबाना चाहिए, उसमें स्टील की इन्फोर्समेंट होनी चाहिए, पिलर की ऊंचाई भी थोड़ी बढ़ानी चाहिए. एक बार ऊंचा और मजबूत पिलर बन जाएगा तब किसी दुर्घटना की सम्भावना नहीं रहेगी.

सावधानी हटी और दुर्घटना घटी

मई २०१० में एक ट्रक ने गेट नंबर १ पर लगे एक पिलर को तोड़ दिया था. देखने के लिए क्लिक करें. काफी नुकसान हुआ था. ईश्वर की कृपा रही कि किसी को चोट नहीं आई. यह सब सावधान न रहने का नतीजा था. अफ़सोस की बात है कि इस दुर्घटना से किसी ने कुछ नहीं सीखा. कुछ दिन पहले एक ट्रक ने फिर गेट पर लगे इस पिलर को नुकसान पहुँचाया. पिलर बीच से बिलकुल टूट गया है, बस ऊपर लगे बैनर्स के सहारे टिका हुआ है और किसी मिनट फिर दुर्घटना हो सकती है, किसी को चोट लग सकती है. गेट से आ-जा रहे किसी व्यक्ति, कार, बाईक, रिक्शा पर यह पिलर गिर सकता है. १८ फरबरी को मैंने इस ब्लॉग पर चेट बोक्स में यह कमेन्ट डाला था पर पार्वा कार्यकारिणी के किसी सदस्य ने इस का नोटिस नहीं लिया.

पिलर को मरम्मत करने या फिर से बनबाने के लिए कुछ नहीं किया गया. आज की ली गई कुछ फोटो में आप पिलर की हालत देख सकते हैं.

पार्वा कार्यकारिणी की यह लापरवाही दुर्घटना को निमंत्रण दे रही है.

विजली की चोरी और जुर्माना

तो आखिरकार विजली की एक चोरी पकड़ी ही गई और जुर्माना भी हो गया. और भी विजली की चोरियां हो रही हैं, अगर पार्वा और अपार्टमेंट्स के निवासियों ने जिम्मेदार नागरिकों की तरह व्यवहार नहीं किया तब इस तरह के और भी जुर्माने होंगे, और सारे निवासियों को शर्मिंदा होना पड़ेगा जब कि यह चोरी कुछ निवासियों द्वारा ही की जाती है. इसी तरह कुछ निवासी पानी की बर्बादी करते हैं जो एक जुर्म है. मैंने इस बारे में ब्लॉग पर लिखा है, कुछ लोगों का ध्यान व्यक्तिगत तौर पर भी इस और दिलाया है पर कुछ असर नहीं हुआ. इन पोस्ट को पढने के लिए क्लिक करें:

आज जब चोकीदार पार्वा का सर्कुलर लेकर आया और मुझसे १०० रूपए मांगे तब मेरी पहली प्रतिक्रिया हुई कि मैं क्यों यह जुर्माना दूं जब मैंने विजली की कोई चोरी नहीं की. जिन्होनें चोरी की है वह भरें जुर्माना. मैंने इस बारे में फिर सोचा, तब मैंने यह तय किया कि ब्लॉग पर अपनी प्रतिक्रिया लिखूं. चोरी हुई है इस में कोई संदेह नहीं. जुर्माना भी होना चाहिए, इसमें भी कोई संदेह नहीं. पर क्या कोई इस से कोई सबक सीखेगा? पार्वा कार्यकारिणी के सर्कुलर के आखिरी पैरा को देख कर ऐसा लगता है कि उन्होंने भी कुछ नहीं सीखा. कुछ निवासियों की गलती की सजा उन निवासियों को क्यों मिले जिन्होनें गलती नहीं की? पार्वा कार्यकारिणी ने बस एक धमकी दे दी अपने सर्कुलर में और उनकी जिम्मेदारी पूरी हो गई. यह शर्म की बात है पार्वा कार्यकारिणी के लिए.

बीएसईस के साथ मिल कर पार्वा कार्यकारिणी एक ऐसा सिस्टम बनाये जिस से अपार्टमेन्ट में की जा रही विजली की चोरियां बंद हों, और अगर फिर भी कोई निवासी विजली की चोरी करता है तब उसी निवासी को सजा मिले. उन विवासियों को सजा देना जो जिम्मेदार नागरिक हैं बहुत गलत बात है. यह एक तरह का अन्नाय है. यह बीएसईस के लिए भी गैरजिम्मेदाराना हरकत है, विजली की चोरी रोकना उनकी जिम्मेदारी है. विजली चोरी की सजा विजली चोरों को न दे कर सामूहिक जुरमाना लगाना अपनी जिम्मेदारी से भागना है, और एक तरह से जिम्मेदार नागरिकों को दिन-दहाड़े लूटना है.

ब्लोक प्रतिनिधियों को यह जिम्मेदारी दी जाय कि वह इस बात पर लगातार निगाह रखें कि कोई निवासी विजली की चोरी तो नहीं कर रहा, अगर ऐसा होता पाया जाय तब उस निवासी को समझाया जाय और न मानने पर कार्यकारिणी उसे नोटिस जारी करे. उस पर भी न मानने पर चोरी के बारे में बीएसईस को सूचित किया जाय.

ऐसा ही पानी की बर्बादी किये जाने पर किया जाय. दिल्ली जल बोर्ड के साथ संपर्क बनाये रखा जाना चाहिए और पानी की बर्बादी रोकी जानी चाहिए.

इस विषय पर विस्तार से विचार होना चाहिए. इसके आम सभा की एक इमरजेंसी मीटिंग बुलाई जाय और उस में उचित निर्णय लिए जाएँ.

वर्तमान पार्वा कार्यकारिणी का यह कार्यकाल अनेक गैरजिम्मेदार घटनाओं से भरा हुआ है. स्वयं पार्वा अध्यक्ष और कुछ ब्लोक प्रतिनिधियों का चुनाव ही अवैध है. ब्लोक प्रतिनिधि तो बस नाम के प्रतिनिधि हैं. उनका होना न होना एक बराबर है. अब जब बीएसईस द्वारा अपार्टमेन्ट में हो रही विजली की चोरी पकड़ी गई है और जुर्माना भी हुआ है तब यह आवश्यक है कि इस से सही सबक सीखा जाय.

PARWA has a new role

MCD is soon constituting Resident Ward Committees (RWC). All Resident Welfare Associations (RWA) in the ward will be member of RWC. RWA will assist councillors in deciding expenditure for development work in their wards. It is compulsory for RWC to meet each month. The minutes of RWC will be sent to the Mayor.

PARWA EC should gear itself up for taking up this responsibility. It should set up a mechanism for effective coordination and cpmmunication with all residents through Block Representatives (BR). In PARWA, BR always remain in hibernation. Now, they will have to come out of their hibernation and take up their job seriously.

गणतंत्र दिवस समारोह

प्रगति अपार्टमेंट्स के निवासियों ने गणतंत्र दिवस को खेल दिवस के रूप में मनाया. राष्ट्र ध्वज फहराया गया. राष्ट्र गान गाया गया.

खेल हुए, बच्चों की दौड़, चम्मच-नीबू दौड़, स्लो साइकिलिंग, तेज चलना, म्यूजिकल चेयर. गर्म काफी की व्यवस्था थी. खाने का कोई स्टाल नहीं था.

GO GREEN PARWA !!!

PARWA, as a residents welfare association, should go green. As afirst step, it should start conserving water. Click on the attached image and read how VK residents are using kitchen waste water in parks. The benefits are -
a) saves fresh water,
b) natural recharge of ground water,
c) economical and eco-friendly method.

On an average, a household uses 300-500 litres of water in the kitchen everyday. This kitchen waste water is tapped before it enters the sewage network. The water is then cleaned in two stages and stored in a tank from where it is pumped out to sprinklers.

Life's Good in Pragati Apartments

Today was Sunday, holiday for all. The air was cold but there was lot of sunshine. It was very pleasant in Central Park. LG had organized a marketing-cum-entertainment meet in Central Park. The function was attended by large number of residents, women and children.

A paiting competition was held for kids. Large number of kids participated in the competition. Another game was held, to speak 10 sentences in Hindi, with 'Life's Good' after every sentence. Many residents participated in it. It was really entertaining. A lady won the game and was given a prize. Some ladies were asked questions and right answers won them prizes. Then came the main even, "Cook & Win".Eleven ladies participated with their food items. A Panel of judges tasted the items and gave marks. THere were prizes for the winners. It was followed by dance by children.

Overall it was a good function. Everybody enjoyed it. LG people deserve to be congratulated and also deserve thanks.

Lohri celebrated in Pragati Apartments

Residents of Pragati Apartments celebrated Lohri on 13.01.2011 in Central Park. The celebration was organized by PARWA EC.

Lohri is celebrated every year on 13th of January. It is a festival to worship fire. Lohri Festival is celebrated with great pomp in North India. At this time Earth starts moving towards the sun marking the auspicious period of Uttarayan. First Lohri is very important for the newly wed and the new born babies as it marks fertility. At night, people gather around the bonfire and throw til, puffed rice & popcorns into the flames of the bonfire. Prayers are offered to the bonfire seeking abundance & prosperity. People make merry by dancing & singing traditional folk songs.

Lohri celebrations are marked by traditional songs and dances. People dress up nicely on the long-awaited bonfire festival. Lohri calls for family get-togethers and lavish dinners with sarson ka saag & makki ki roti. The day ends with prayers for a good harvest.

Time seems to have changed in Pragati Apartments. In the Lohri here, dancing & singing traditional folk songs was missing. People no doubt threw popcorns, moongfali and rewri in the fire. No prayers were offered to the bonfire seeking abundance & prosperity. Any way it was an entertaining evening with many people around and cold air and soothing warmth of bonefire. Many residents distributed rewari, moongfali and popcorns as prasad.

Bi-annual PARWA GB Meeting

Bi-annual General Body meeting of Pragati Apartments Welfare Association (PARWA) was held on 09.01.2011 in Central Park. It was almost like other GB meetings, no quoram at 1000 AM (only six members), meeting started at 1030 AM with 12 members, same routine agenda, Secretary read the report in a mechanical manner, no new issues, no proactive plans, self praise, a perfect photocopy of earlier GB meetings. Some members in PARWA EC are real tired, no new ideas, but they do not want to retire. Any way it their choice and no-choice of residents.

PARWA members have been provided a copy of the meeting notice with agenda, Secretary's report and mintes of the meeting. A formaility is over. Members can read these documents at their free time. It they do not read then also it will not make any difference.

There was no discussion on payment for second slot but Secretary has written about a decision on this. Mr Malik has a quality, he will record in the meeting minutes what he wants to record, and for him vice-versa is also true.

Now the next GB meeting will be held after announcement of next election. The floor is with President and Secretary till then.

कचरा संस्कृति

एक महिला परेशान खोई-खोई अपने बरामदे में टहल रही थी. दोपहर का वक़्त था. उनकी पडोसन भी अपने बरामदे में आईं. इन परेशान महिला को देखा तो बोलीं, 'क्या बात है बहन, बड़ी परेशान लग रही हो. सब ठीक तो है न?'

महिला, 'हाँ सब ठीक है, बस कुछ उलझन सी हो रही है'.

पडोसन, कैसी उलझन?'

महिला, 'ऐसा लग रहा है जैसे मैंने कुछ करना था पर किया नहीं और अब याद भी नहीं आ रहा कि क्या करना था.'

पडोसन, 'अरे तो इस में परेशान क्या होना. एक-एक करके गिन लो कि क्या करना था और क्या नहीं किया. सुबह उठने से शुरू करो.

'हाँ यह ठीक है', महिला ने खुश हो कर कहा और मन ही मन गिनना शुरू किया. कुछ ही देर में ख़ुशी से चिल्लाईं, 'याद आ गया. आज मैंने अभी तक पार्क में कचरा नहीं फेंका. बस इसी बात से उलझन हो रही थी.'

पडोसन, 'चलो ठीक हुआ, अब जल्दी से कचरा फेंको पार्क में और इस उलझन से छुटकारा पाओ'.'

महिला ने जोर से आवाज लगाईं, 'अरे बहू जल्दी दे प्लास्टिक में डाल कर कचरा दे, पार्क में फेंकना है.'

'पर सासूजी कचरा तो सारा जमादार ले गया.' बहू अन्दर से चिल्लाई.

'थोडा बचाकर नहीं रख सकती थी मेरे लिए? रोज पार्क में कचरा फेंकती हूँ जानती नहीं क्या?' महिला गुस्से से चिल्लाईं.

बहू बाहर आकर बोली, 'मैंने सोचा आपने फेंक दिया होगा. रोज सुबह आप सबसे पहला काम आप यही तो करती हैं.'

'अरे आज भूल गई', महिला बोली, 'अब जल्दी से कुछ कचरा तैयार करके ले आ. जब तक कचरा पार्क में नहीं फेंकूँगी मेरी उलझन दूर नहीं होगी'.

'अब इतनी जल्दी कचरा कहाँ से पैदा करूँ?, बहू ने कहा.

'हे भगवान्, किस गंवार को हमारे पल्ले बाँध दिया. जरा सा कचरा तक नहीं पैदा कर सकती.' महिला ने परेशानी में अपने माथे पर हाथ मारा.

बहू कुछ नहीं बोली और झल्लाती हुई अन्दर चली गई. मन में सोचा, बाबूजी को क्यों नहीं फेंक देती पार्क में, बेचारों का हर समय कचरा करती रहती है.

इधर महिला और परेशान हो गई. अचानक ही उन्हें एक आईडिया सूझा. उन्होंने अपनी पडोसन से कहा, 'बहन आपके यहाँ थोडा कचरा होगा? मुझे दे दीजिये कल लोटा दूँगी. मेरा आज का काम हो जाएगा.'

'हाँ हाँ बहन ले लीजिये कचरा और लौटाने की कोई जरूरत नहीं. आप अक्सर चाय, चीनी, दूध मांगती रहती हैं. कभी लौटाया है क्या कि अब कचरा लौटाएँगी'. पडोसन मुस्कुराते हुए बोली.

महिला तिलमिलाईं पर हंसते हुए बोली, 'अब जल्दी से मंगवा दो न कचरा.'

पडोसन ने अपनी बहू को आवाज दी, 'अरे बहू थोडा कचरा एक प्लास्टिक में डाल कर ले आ. आंटी को पार्क में फेंकना है.'

बहू कचरा ले कर आई और आंटी को दे दिया. महिला ने कचरे से भरा प्लास्टिक पार्क में फेंक दिया. दूर बैठा एक कुत्ता दौड़ा हुआ आया आया. प्लास्टिक को फाड़ा और कचरे को इधर उधर फैला दिया.

महिला के चेहरे पर प्रसन्नता और शान्ति का भाव था, ऐसा लग रहा था जैसे उन्होंने कोई महान सामजिक और सांस्कृतिक कर्तव्य पूरा किया हो. वह हंसते हुए पड़ोसन से बोली, 'बहन आपका बहुत बहुत धन्यवाद. आपका यह उपकार जिंदगी भर नहीं भूलूंगी.'

पड़ोसन बोली, 'पड़ोसी होते किस लिए हैं?'

सरकारी जमीन पर कब्जा करने का आत्मिक सुख

आज सुबह पार्क में सिन्हा साहब बहुत खुश नजर आ रहे थे. मुहाबरे की भाषा में कहें तो, ख़ुशी फूटी पड़ रही थी उनके चेहरे पर. बैसे ध्यान से देखने पर अत्यधिक प्रसन्न सिन्हा साहब के चेहरे पर कुछ परेशानी भी नजर आ रही थी. अत्यधिक प्रसन्नता और कुछ परेशानी का ऐसा अद्भुत संगम मैंने पहले कभी नहीं देखा था. कई लोगों ने पूछा पर उन्होंने अपनी इस प्रसन्नता और परेशानी को किसी के साथ बांटा नहीं था. जब मेरी उत्सुकता मुझे परेशान करने लगी तो मैं भी उनके पास पहुँच गया.

मुझे देखते ही बोले, 'दीवान साहब नहीं आये अभी तक?'

दीवान साहब उनके लंगोटिया यार हैं. तो यह कारण था उनकी परेशानी का. ख़ुशी की बात दीवान साहब को न बता पाने के कारण परेशान थे सिन्हा साहब. खैर यह परेशानी ज्यादा देर नहीं रही. दीवान साहब भी आ गए.

सिन्हा साहब ने अपनी शिकायत दर्ज कराई, 'कहाँ रह गए थे यार? इतनी देर से इंतज़ार कर रहा हूँ.'

'यार कल रात दारू पार्टी ज्यादा देर तक चली. उठने में देर हो गई', सिन्हा साहब ने सफाई दी और पूछा, 'तुम कहाँ रहे कल? पार्टी में नहीं आये'.

'अरे यही तो बताना है तम्हें' सिन्हा साहब ने कहा और दीवान साहब का बाजू पकड़ कर उन्हें झाडियों की तरफ ले गए.

मैं भी खिसका और झाडियों की दूसरी तरफ छिप कर खड़ा हो गया. सिन्हा साहब ने दीवान साहब को जो बताया वह मैं आपको बता रहा हूँ, पर इस शर्त के साथ कि आप किसी और को नहीं बताएँगे.

दीवान साहब, 'हाँ अब बताओ.'

सिन्हा साहब, 'यार तुम तो जानते ही हो कि ईश्वर ने मुझे हर गलत काम करने का आत्मिक सुख दिया, पर सरकारी जमीन पर कब्जा करने के आत्मिक सुख से अभी तक बंचित कर रखा था. कल वह सुख भी प्राप्त हो गया'.

दीवान साहब, 'भई वधाई हो, अब जल्दी से खुलासा कर के बताओ'.

सिन्हा साहब, 'तुम्हे पता ही है कि मैं बेटे की शादी कर रहा हूँ और उस के लिए मकान में कुछ फेर बदल करवा रहा हूँ'.

दीवान साहब, 'हाँ हाँ मालूम है, अब आगे कहो'.

सिन्हा साहब, 'दो दिन से पिछले कमरे में काम चल रहा था कि तुम्हारी भाभी ने एक आइडिया दिया. क्यों न सड़क की तरफ दीवार बढा कर एक अलमारी और एक स्टोर बना लें? इस से कमरे में जगह भी खूब मिल जायेगी और सरकारी जमीन पर कब्जा करने का तुम्हारा सपना भी पूरा हो जाएगा. मेरी तो बांछे खिल गई यार, क्या आइडिया दिया था बीबी ने'.

दीवान साहब, 'वाह क्या बात है. किसी ने सही कहा है कि हर सफल आदमी के पीछे एक औरत होती है'.

सिन्हा साहब, 'हाँ यार, भगवान् ऐसी बीबी किसी दुश्मन को न दे. कल रात जा कर यह महान काम पूरा हुआ. तब से एक गहरे आत्मिक आनंद का अनुभव कर रहा हूँ'.

दीवान साहब, 'लेकिन लोग ऐतराज नहीं करेंगे क्या? सड़क बैसे ही काफी तंग है, अब तो और भी तंग हो जायेगी'.

सिन्हा साहब, 'अरे यार यह बात तो मेरे इस आत्मिक आनंद को दुगना कर रही है. आपके कारण पडोसी परेशान हों, इसी में तो मनुष्य जीवन की सफलता है. एक मीठी गुदगुदी सी महसूस कर रहा हूँ अपने अन्दर. आज जब दिन में सब देखेंगे और जलेंगे तो कितना आनंद मिलेगा हमें'.

दीवान साहब, 'अगर किसी ने शिकायत कर दी तो?'.

सिन्हा साहब, 'अरे वह तो शायद कर भी चुके लोग. पुलिस वाले और नगर निगम वाले आये थे और अपनी भेंट ले कर चले गए. अब माता रानी को भेंट और चढानी है. आखिर उनकी कृपा से ही तो यह सब संभव हुआ है'

दीवान साहब, 'वधाई हो, अब मिठाई कब खिला रहे हो?'.

सिन्हा साहब, 'क्या यार तुम भी, मिठाई नहीं दारू और मुर्गे की बात करो. माता रानी की कृपा हुई है, क्या मिठाई से निपटा दूंगा? फाइव स्टार में पार्टी होगी यार'.

दीवान साहब, 'जय माता रानी की. चलो अब चलते हैं, माँ की कृपा के दर्शन तो कर लें'.

यह तो हद हो गई गैरजिम्मेदारी की

पिछले एक महीने से यह गड्ढा खुदा हुआ है. इसे पानी की लीकेज को ठीक करने के लिए खोदा गया था. न लीकेज ठीक हुई और न ही गड्ढा भरा गया. पार्वा कार्यकारिणी गैरजिम्मेदार है यह तो सभी जानते हैं पर यह तो हद हो गई है गैरजिम्मेदारी की.

सी-ब्लाक के साथ पार्वा कार्यकारिणी का व्यवहार हमेशा सौतेला रहा है. चाहे वह गेट नंबर २ को खोलने का समय हो, चाहे वह फव्वारे वाले पार्क की देख रेख हो, चाहे थोड़ी सी वारिश होने पर पानी जमा हो जाना हो, चाहे सीवर जाम हो जाना हो, गन्दा और बदबूदार पानी घरों के बाहर बह रहा हो, चाहे कम्युनिटी सेंटर में ऊंची आवाज में कार्यक्रम हो रहा हो, पार्वा कार्यकारिणी को इन सब से कुछ लेना-देना नहीं होता. पार्वा कार्यकारिणी को तकलीफ तब होती है जब ए या बी ब्लाक में कोई तकलीफ हो.

सी ब्लाक से दो प्रतिनिधि पार्वा कार्यकारिणी में हैं, श्री धवन और श्री पालीवाल. यह दोनों महाशय क्या करते रहते हैं? क्या इन्हें कुछ नजर नहीं आता? क्या आज तक इन लोगों ने सी-ब्लाक की किसी समस्या की पार्वा कार्यकारिणी की मीटिंग में उठाया है? आज तक इन्होनें ब्लाक के निवासियों के साथ कोई मीटिंग नहीं की. इनकी कोई जिम्मेदारी है या नहीं? ऐसे गैरजिम्मेदार प्रतिनिधि के होते सी-ब्लाक की किसी समस्या का सुलझना संभव नहीं है. अगर यह लोग काम नहीं कर सकते तब इस्तीफा दें.

कौन भरवाएगा इस गड्ढे को? किस की जिम्मेदारी है यह? कभी भी कोई दुर्घटना हो सकती है.

भगवती माँ की चौकी

विशाल भगवती जागरण समिति ने कल भगवती माँ की चौकी का आयोजन किया. यह आयोजन प्रगति अपार्टमेंट्स के सेन्ट्रल पार्क में हुआ. सारा प्रगति अपार्टमेंट्स माँ के भजनों की मधुर ध्वनि से गूँज उठा. माँ के दरबार की शोभा देखते ही बनती थी. सब निवासियों ने भक्ति, श्रद्धा और हर्षोल्लास से माँ का कीर्तन किया. आयोजकों ने माँ का भण्डारा भी लगाया था. सब भक्तों ने श्रद्धा और प्रेम से माँ का प्रसाद ग्रहण किया.

पिछले वर्ष के आयोजन से अगर तुलना की जाय तब इस वर्ष पूरा आयोजन अत्यंत सुचारू ढंग से किया गया. इसके लिए सभी आयोजक धन्यवाद और वधाई के पात्र हैं. उनके साथ जो स्व इच्छा से सेवादार काम कर रहे थे वह सब भी धन्यवाद और वधाई के पात्र हैं. युवा वर्ग इस में काफी उत्साह से शामिल हुआ. यह बहुत ही ख़ुशी और संतोष की बात है.

भजन मण्डली की जितनी प्रशंसा की जाय कम है. मधुर स्वरों में गाई गईं भेंटो ने एक अजब ही समाँ बाँध दिया.

नगर कीर्तन

धन-धन श्री गुरु नानक देव जी के प्रकाशोत्सव पर आयोजित नगर कीर्तन आज सुबह प्रगति अपार्टमेंट्स से होकर निकला. वाहे गुरु जी के कीर्तन से सारा प्रगति अपार्टमेन्ट गूँज गया. निवासियों ने उत्साह और हर्षोल्लास से कीर्तन का स्वागत किया. भक्तों ने असीम श्रद्धा और विश्वास के साथ गुरु का प्रसाद ग्रहण किया. मैंने कुछ फोटो खींचे. आप भी देखिये.

शिक्षित नागरिक और पानी की बर्बादी

एक और बात जो मुझे तकलीफ पहुंचाती है वह है पानी की बर्बादी. पानी जीवन है. पानी की एक-एक बूँद कीमती है. जैसा मैंने पहले कहा है, प्रगति अपार्टमेंट्स में शिक्षित लोग रहते हैं, जिन्हें उनके कर्तव्य याद दिलाना अच्छा नहीं लगता. एक-दो निवासियों से मैंने कहा भी पर वह लड़ने के लिए तैयार हो गए. 'आपको क्या तकलीफ हो रही है? आपका पानी बर्बाद कर रहे हैं क्या? पैसे देते हैं दिल्ली जल बोर्ड को? आप अपने काम से काम रखिये. हमारे मामलों में टांग मत अड़ाइये' - यह वह जवाब हैं जो अक्सर सुनने को मिलते हैं. लोग गलत काम करेंगे, कानून तोड़ेंगे, प्राकृतिक संसाधन बर्बाद करेंगे, पर अगर आपने कुछ कह दिया तो लड़ने पर आमादा हो जायेंगे.

पानी के टेंकों से पानी गिरता रहता है पर किसी को कोई तकलीफ नहीं होती. टेंक की मरम्मत करने में कोई विशेष खर्चा नहीं आएगा पर इन शिक्षित लोगों के मन में यह ख्याल ही नहीं आता कि वह पानी की बर्बादी कर रहे हैं.

कुछ लोग पानी की लाइन में पाइप लगा कर कार/स्कूटर धोते हैं, पोधों को पानी देते हैं, घर का बरामदा/सीड़ियाँ धोते हैं. यह काम थोडा पानी खर्च करके हो सकते हैं पर लोग इतनी बेदर्दी से पानी बहाते हैं कि उनके शिक्षित होने पर ही संदेह होने लगता है.

कौन समझाएगा इन्हें? यह खुद तो समझने वाले हैं नहीं. पार्वा कार्यकारिणी को इस विषय में उचित निर्देश जारी करने चाहियें.

शिक्षित नागरिक और विजली की चोरी

प्रगति अपार्टमेंट्स में जो लोग रहते हैं सब शिक्षित हैं. उन में से कुछ शिक्षित लोग पार्वा कार्यकारिणी में हैं. यह बहुत दुःख और असंतोष का विषय है कि प्रगति अपार्टमेंट्स में जितने फंक्शन होते हैं उनमें अधिकाँश में ऐसा लगता है कि विजली की चोरी होती है. पिछला फंक्शन था दीवाली मेला. यह मेला आप जानते हैं पार्वा कार्यकारिणी द्वारा आयोजित किया गया था. उस फंक्शन में जो विजली की लड़ी लगाईं गई थी वह अभी भी लगी हुई है. आज सुबह जब मैंने उस पर ध्यान दिया तो पाया कि इस लड़ी में विजली के खम्बे से कनेक्शन जोड़ा गया है. ३० अक्टूबर से यह लड़ी लगातार हर रात जलती है.

क्यों करते हैं लोग ऐसा? सब जानते हैं कि यह गैरकानूनी है. और ऐसा करके वह कितना पैसा बचा लेते हैं? पार्वा कार्यकारिणी के सदस्यों को कोई व्यक्तिगत फायदा भी नहीं हो रहा है. यह पार्वा का फंक्शन है, पार्वा उस पर खर्चा करती है. फिर क्यों गैरकानूनी काम किया जाता है? मैं बार-बार इस बात पर ध्यान दिलाता हूँ पर कोई असर ही नहीं होता. मैं पार्वा का एक सदस्य हूँ, मुझे बहुत तकलीफ होती है जब पार्वा कार्यकारिणी कोई गैरकानूनी काम करती है.

अगर किसी दिन सम्बंधित सरकारी विभाग द्वारा कोई कार्यवाही कर दी गई तब अपार्टमेंट्स के सभी निवासियों को शर्मिंदगी उठानी पड़ेगी. जिस प्रगति अपार्टमेंट्स की सब तारीफ़ करते हैं वह क्या सोचेंगे जब यह असलियत सामने आएगी?

इस ब्लॉग के माध्यम से, मैं, पार्वा का एक सदस्य, प्रगति अपार्टमेंट्स का एक निवासी, पार्वा कार्यकारिणी के सभी सदस्यों से अपील करता हूँ कि आवश्यक कदम उठायें और यह सुनिश्चित करें कि अपार्टमेन्ट में कोई गैरकानूनी काम न हो.

डीजल जेनरेटर अभी भी अपार्टमेन्ट से हटाया नहीं गया है. ऐसा क्यों है?

खूब पटाखे बजाये,

खूब शोर मचाया,

पर जगे नहीं, सोते रहे,

प्रगाढ़ निद्रा में,

झूट, चोरी, बेईमानी,

नफरत, हिंसा, अन्याय की.

खूब दिए जलाए,

मोमबत्तियां जलाईं,

विजली की रंग-बिरंगी,

झालरें जलाईं,

पर मिटा नहीं अँधेरा,

इस वर्ष पार्वा ने दीवाली पूजन नहीं किया

पार्वा ने पिछले वर्ष दीवाली पर पूजन का आयोजन किया था. श्री ओ एन शर्मा ने पूजन करवाया था. मैंने कुछ वीडिओ बनाईं थीं. देखने के लिए क्लिक करें.

इस वर्ष पार्वा ने दीवाली पूजन का आयोजन नहीं किया. आज सुबह तक न तो कोई सर्कुलर आया और न ही नोटिस बोर्ड पर ऐसी कोई सूचना दी गई. मैंने श्री ओ एन शर्मा से इस बारे में पूछा, पर उन्होंने अनभिज्ञता प्रकट की.

दीवाली पूजन एक अच्छी परम्परा है. इस वर्ष इस परम्परा को तोड़ने का क्या कारण रहा होगा? वर्तमान पार्वा कार्यकारिणी के काम करने का तरीका मेरी समझ में नहीं आ रहा. दीवाली मेले में पार्वा कार्यकारिणी के अधिकाँश सदस्य अनुपस्थित थे. इस वर्ष पार्वा दिवस भी इस तरह मनाया गया की किसी को पता ही नहीं चला.

दीवाली मेला - दिवस २

दीवाली मेले के दूसरे दिन का आयोजन भी कोई विशेष उत्साहवर्धक नहीं रहा. बस इतना अंतर था कि ओवरहेड लाईट्स जली हुई थीं. पहले दिन से रौशनी कुछ ज्यादा थी. बच्चो की डांस प्रतियोगता और तम्बोला, बस यही दो कार्यक्रम थे.

मैं जब भी स्टेज की और देखता मुझे लगता कि यह मेला है या कोई सेमिनार? स्टेज पर मेज और कुर्सियां लगी थीं, कुर्सियों पर नेता लोग जमे हुए थे. पार्वा कार्यकारिणी के अधिकाँश सदस्य कल की तरह आज भी गायब थे. प्रधानजी चुप थे, सचिव और एक बीआर बिना रुके बोल रहे थे. बच्चे जमीन पर डांस कर रहे थे. पीछे बैठे दर्शकों को कुछ दिखाई नहीं दे रहा था. अधिकाँश लोगों का ध्यान खाने पर केन्द्रित था. जो अपार्टमेन्ट के बाहर से आये थे, चुनींदा स्टाल्स पर इकट्ठे थे.

कल की तरह जेनरेटर आज भी नहीं चल रहा था. मतलब विजली कहीं और से आ रही थी. मैंने ३१ तारीख की सुबह कुछ फोटो खींची थीं. आप भी देखिये. कानून तोडना क्या जरूरी था? पार्वा कार्यकारिणी ने ऐसा क्यों किया मैं यह नहीं समझ पाया. कितना पैसा बचाया उन्होंने यह कर के? प्रगति अपार्टमेंट्स के निवासियों को शर्मिंदा किया. कल को अगर कोई समस्या खड़ी हो जाती है तो प्रगति अपार्टमेंट्स का नाम बदनाम होगा. शिक्षित लोगों से यह आशा नहीं की जाती.

यह कार्यक्रम पार्वा कार्यकारिणी द्वारा आयोजित था. इस में कानून का उल्लंघन हुआ. पार्वा कार्यकारिणी निवासियों द्वारा आयोजित कार्यक्रमों को भी इजाजत देती है, बदले में कुछ शुल्क लेती है. इन कार्यक्रमों में अगर ध्वनि निरोधक कानून का उल्लंघन होता है या विजली की चोरी होती है, तब उसकी जिम्मेदारी भी पार्वा कार्यकारिणी पर ही आती है. पार्वा अध्यक्ष , सचिव और अन्य पदाधिकारियों/सदस्यों को इस बारे में सावधान रहना चाहिए.

चलिए वर्ष २०१० का दीवाली मेला संपन्न हुआ. आशा है वर्ष २०११ का दीवाली मेला एक नए रूप में खूब धूमधाम से आयोजित किया जाएगा.

विगत वर्षों की भांति, इस वर्ष भी पार्वा कार्यकारिणी ने प्रगति अपार्टमेंट्स में दो दिवसीय दीवाली मेले का आयोजन किया है. पछले वर्षों के मुकाबले में पहले दिन का आयोजन कुछ फीका रहा. रौशनी बहुत कम थी. स्टाल्स में लगभग अँधेरा था. मैंने कुछ फोटो लेने की कोशिश की पर पर्याप्त रौशनी न होने के कारण फोटो खिंच नहीं पाए.
महंगाई का असर दीवाली मेले पर भी हुआ. खाने की वस्तुओं के दाम बहुत ज्यादा थे. पार्वा कार्यकारिणी के एक सदस्य ने इस बात पर ऐतराज जताया पर उन्हें प्रधान और सचिव ने चुप करा दिया. कुछ और लोग भी अधिक कीमतों का विरोध करते सुने गए.
पार्वा कार्यकारिणी के सभी सदस्य आयोजन में सम्मिलित नहीं थे. क्यों ?
जो जेनरेटर मेले में विजली देने के लिए लाया गया था वह पूरे समय बंद रहा. "विजली कहाँ से आई?", यह एक ऐसा प्रश्न था जो कई लोगों ने उठाया. दबी जुबान में लोग यह कहते सुने गए कि विजली की चोरी हो रही है. मैंने यह बात पार्वा कार्यकारिणी के एक सदस्य से कही तब उन्होंने इस के लिए अपार्टमेंट्स के सभी निवासियों को जिम्मेदार ठहरा दिया. मैं इस ब्लॉग के माध्यम से विजली चोरी का विरोध करता हूँ. अगर कोई चोरी हुई है तब उस के लिए केवल पार्वा कार्यकारिणी के सदस्य जिम्मेदार हैं. मैं यह निवेदन भी करता हूँ कि पार्वा कार्यकारिणी को कोई भी ऐसा कार्य नहीं करना चाहिए जो देश के किसी कानून का परोक्ष या अपरोक्ष रूप से उल्लंघन हो. मैंने इस ब्लॉग के माध्यम से कई बार पार्वा कार्यकारिणी का ध्यान ध्वनि प्रदूषण कानून की और भी दिलाया है, लेकिन कल फिर एकाउस्टिक एनक्लोजर रहित जेनरेटर मंगाया गया.
कुछ स्टाल्स पर जुआ होने की ख़बरें भी सुनाई दीं. पब्लिक एड्रेस सिस्टम पर जुआ खिलाने और खेलने वालों को सावधान किया गया पर कोई और कार्यवाही नहीं की गई.
पिछले कई सालों से दीवाली मेला एक ही पैटर्न पर हो रहा है. इस वर्ष भी कोई नया खेल या आईटम नहीं जोड़ा गया.
बच्चों को अपने आइटम पेश करने में दिक्कत हुई. इस के लिए कोई स्टेज नहीं बनाया गया. पीछे बैठे दर्शकों को कुछ दिखाई ही नहीं पड़ रहा था.
ले देकर पहले दिन का आयोजन उत्साहवर्धक नहीं रहा. मजा नहीं आया. आशा है आज का आयोजन ठीक रहेगा.
प्रधान और सचिव को इस विषय पर अपनी टिपण्णी करनी चाहिए.

For last few days I have been watching the development in PARWA EC. Bickerings in PARWA EC are ON again. Security has always been a bane of contention in Pragati Apartments. Vice-president is in-charge of security. During my brief association with PARWA EC, I have seen that President and Secretary always act as super-in-charge of every thing in PARWA including security. They, as a routine, interfere in the job of security in-charge. This creates disaffection between PARWA officer bearers and also between security guards. I have seen it happening in last PARWA EC. From what I have heard and seen, it is happening in current PARWA EC also. The difference is taht the bickerings have overshoot this time. An unpleasant situation has been created where President himself became security in-charge.

Services of two guards were terminated. This is when PARWA is always short of security guards. One security guard was handed over to police on a petty matter of a missing phone instrment. The circumstances under which the phone instrument went missing and later found abandoned in a park speak volumes of the bad blood flowing between officer bearers of PARWA. This is compromising the security of the apartments. Any time any unpleasant incident cam happen.

I demand that President, Vice-president and Secretary should explain this to PARWA members, and assure that such bickerings will stop forthwith and affairs of PARWA will be run in an atmosphere of trust and respect for each other. All groups and counter-groups should be demolished and PARWA EC should act as one unit.

PARWA EC - be careful not to violate any law

It looks as PARWA EC has not taken any notice of my advice. On October 8, 2010 again a DG set without acoustic enclosure was allowed to be used in a function organized in Central Park of Pragati Apartments. When I went there at about 7 PM, the DG set was ON and it was making hell of a noise. I feel pity on the residents living in flats across the road.

I wonder why PARWA EC has not introduced a condition that any resident using parks or other space in the apartments for any function will ensure that resident/tentwala do not used a DG set without acoustic enclosure. This condition can be easily printed in the application form which residents are required to fill for allowing them to use the parks and other spaces for organizing any function. A designated PARWA EC member can then monitor that all conditions are complied with.

PARWA is a representative body of all residents of Pragati Apartments. The residents should not be put in a situation where PARWA and its members are found violating any law just because PARWA EC has not acted wisely and according to law.
